YES, that is what the AP document is used for.

Is now a US Citizen immigration completed Jan 12, 2012.

I had read in another forum that even if you have recived the AP if your case is still in process it is not safe to travel because you could be denied entry. that is why i am asking

That's what AP is for - if your case wasn't still processing, you wouldn't need the AP. :thumbs:

Only in a case where a person is adjusting status through marriage to a US-Citizen after a long OVER-STAY on a non immigrant visa.

The Overstay can cause a denied entry.

I had read in another forum that even if you have recived the AP if your case is still in process it is not safe to travel because you could be denied entry. that is why i am asking

Yes thanks for the reply. I had teh exact question. I am a 3 yr overstay. I go my EAD notice recently and was thinking about going to canada. my aos interview is in late feb.

Should i stay put in usa until the aos interview?

EAD does not grant you re-entry permission... that is what AP is for... In your situation, even if you had AP it might not get you back in because of the overstay... Do not leave until greencard is in your possession

I would, specially since your AOS interview is so close.

And if you have 2nd thoughts about it, here is an article, which although is not a k1 visa person, it goes to show you that you don't play around when it comes to immigration matters in this post 9-11 world!

2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.
