He's telling you the same thing I did. They don't just expire if they are being reviewed. . . .if it says pending then you all need to consult an attorney and formally cancel the petition so that they do not revoke it. . . .the Ellis article he refers to is the one I linked you to and the one that specifically talks about review of I-129F's. . .

He is telling you the same correct information I have been.

Did you call USCIS like we talked about?

Emt has been and is one of the most helpful members on this forum, and I believing taking her advice is a smart thing to do not rebel against it. Again, emt, thank you for all your help that you give everyone here. To the OP, I hope your situation is cleared and that the rest of your visa processing goes well.

Thanks everyone for the suggestions.I really appreciate that .

I tried to call several times but I couldn't manage to talk to the them in USCIS. As for the used my case number and track the petiton online I do it all the time and see the same answer all the time. Will will notify you when we make the decision.

My husband hasn't received anything from them so far.

I tried to contact to those ppl from different websites who had been in the same situation as I am in now. All of them say that USCIS said it would review returned petitions (K-1 petitions) after 4 years or so. But I will continue calling them and hopefully finally I will know the answer for my returned petition.

Here is what I also found in this forum written by one of your members:

"When you file a new petition, it is filed with USCIS. On the I-130 it asks if you have filed for anyone before. You list there the previous petition and who it was for (the same beneficiary). It also asks for outcome of that previous petition. You include your evidence of your relationship and rebuttal of the alleged allegations against your relationship that were used to deny at the embassy. This action will necessitate USCIS pulling the returned petition for review in order to adjudicate the 2nd one. (Rather than waiting in the last priority pile returned petitions go into.)

Once the new petition is approved, including consideration of the 1st returned petition and the alleged reasons for the prior denial, DOS should approve the visa......"

Thanks everyone again.

God will bless you all

That information you quoted from this site, does not trump the published article by an experience immigration attorney that desertfox and I referenced for you. You need to cancel the original petition before it is revoked or follow up on it to make sure it does not get revoked.
