I am not legally divorced yet...but all the paperwork has been filed...do I have to wait to for us to apply for a K1 until the divorce is final? That takes about 90+ days...or can we apply and wait since my divorce will be final while we are waiting for the K1 to go through?

Roughly how long does it take for a K1?

You must be free to marry at the time the petition is submitted - you must submit a final divorce decree with the petition. :thumbs:

K1 processing is around 140 days on average right now.

Not being all that familiar with the K1 processing times - that '140 days' on average, is that from I-130 submittal to interview or ?

It's about 140 days from the I129-F submission to the NOA2. Then another 2-4 months for the interview.

Removing Conditions

Sent package to VSC - 8/12/11

NOA1 - 8/16/11

Biometrics - 9/14/11
