HELP!!! My wife was denied.

I just Noticed you are in Hawaii, That might have something to do with it, Mail in the continental USA is usually fast anyway, But from Hawaii it would make sense it would take 10 days maybe.

just wanted to add that in my area the senator dont handle immigration but the congressmans office does. it seams like different places do it differently then others.

What I should have done doesn't matter to me now. I thought I was getting express mail. I told the postal worker I wanted it to get there asap. I didn't understand the difference between express, first class and priority, now I do. From now on I'm sending everything fed ex overnight.

Anyways I am sending in my petition to reopen this case, claiming that it was sent in a timely manner. I have proof that it was sent in a timely manner and am sending in a page from the us postal service website showing that they claim that first class mail arrives within 3 days (Hawaii included) On the web page it only says that larger packages to/from Hawaii take longer. There was no abandonment on my part. It is out of my control if the postal service does not provide service consistent to what they are claiming. It took 2 weeks and 3 days for an envelope to arrive when they claim it would arrive much faster.

Call senator Dan Inouyes office in Honolulu. They were VERY helpful for me and other friends.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Ok basically we were in the process of removing the conditional status on my wife. The uscis sent a letter requesting evidence and I needed to respond by Nov. 18th. We were waiting on some documents from State farm, so once we received them I got everything together and sent it off to the uscis on Nov. 12th. I told the post office worker that it needed to get there asap. I figured a week would be a lot of time for the papers to get there by the 18th.

My wife recently received a letter in the mail saying that her residence was denied due to abandonment. They are saying that they did not receive the evidence requested by the due date. Because it is an abandonment we cannot appeal but we can only file for a motion to reopen the decision.

Does anybody have any info on this. My wife and I are so stressed out. I could not have helped it if the post office screwed up and took forever for them to send my evidence. I have a certified mail receipt saying that I sent the envelope on the 12th. What can I do?? Are they going to deport my wife, because the post office took to long to send the evidence? Do I have any chance at explaining this to an immigration judge and reversing the decision. I'll talk all the info I can get

Hi, this happened to someone I know a few years ago. She was placed in removal proceedings and went before an immigration Judge. Her removal proceedings were terminated and she was allowed to continue with her petition. USCIS claimed that she abandoned her pettion to removal conditions on her greencard.

Sorry dude, I didn't mean to increase your anxiety, you are right it should not have taken that long even with a regular letter,

I like you said it is what it is and it seems like you will be fine,

Anyway, in most cases the senior Senator in each state has more clout than a member of the House of Representatives. Sen. Inouye is one of the best.

I ordered an Ipod which shipped from China, had it in 3 days, with LASER engraving.

3 days from China and 10 days from Hawaii???

I called Senator Inouye's office and they were very very helpful. I guess I just need to wait until they get back to me.

When I delt with his office they {Barbara or Jackie} followed up VERY fast.

Same thing with one of my friends. His petition was "lost" at NVC. Next day after he called Inouyes office it was on it's way to Manila. Maybe just a coincidence but who knows?

He does have clout!

I thought I should give everybody an update on what happened.... So after contacting my Senators office, the lady said that I should fax over to her my denial letter and copies of my mailing and delivery confirmation receipts. After doing so, she told me that she would make an inquiry and that she would get back to me. about 1 week passed and she called to tell me that the uscis finally responded saying that they were putting our case on review. They said that they were going to try and locate the evidence that I sent and they would respond within 30 days.

Two days passed...... I received a phone call from my senators office again with great news!!! She said that the case was approved and that my wife would be getting her 10 year green card with in 30 days. Yeeaaaahhh. She also said that they probably realized that it was just an error. I am soooo relieved. I just hope that people can learn from my experience. I know that I will be sending future important information via fedex or ups overnight delivery even if I'm sending it weeks in advance.

Thank you to those people who referred me to the senators office. They saved me $580 in fees since I didn't even have to file for the motion to re-open.. All it took was one phone call and a fax to my senators office.
