I stand corrected:

but that sheitt about CR-1 is the best way is just that, BS.

It depends on what you need to accomplish. while the cr-1 will have less headaches and a bit bit cheaper in the long run, K-3's are quicker and allow easier process for dependents.

K-1;s are even faster than k-3's

Actually, my quoted text is NOT BS. It is fact. When approved with a K-1 and K-3 it is a single entry visa which requires the visa holder to adjust status upon entry into the U.S. to a perminant resient. With a CR-1, upon approval you are automatically granted a green card which allows you to work and travel.

So if the CR1 is only good for two years, do I have to keep getting it renewed?

How long till I can apply for U.S citizenship?

Also, can I travel to visit my future spouse while the CR1 is pending?

After your CR-1 is approved you will be granted a 2 year temporary green card. You will need to apply to have the conditions removed after 2 years and then you will be given a 10 year green card. You may apply for citizenship after 3 years (I think). You may hold dual Canadian and American citizenship!

Yes, you can. But it becomes more difficult and there are some stories here of spouses getting denied entry. However, there are plenty of stories of spouses showing strong ties to their home country and getting granted entry. Bascially it is not guarenteed but if you always tell the truth and be confident in your answers, there should be no problems.

Again not quiet correct.

K-1 is single entry, and is not REQUIRED to adjust status upon entry, they are required to marry the petitioner, or leave the USA when the I-94 expires, they can only adjust status AFTER they marry the petitioner.

K-3 is MULTI-entry, again they are not REQUIRED to adjust status upon entry, they have up to 2 years to either adjust status or they can wait for the I-130 to process through NVC and return home for a CR-1 or perhaps IR-1 visa interview. If the K-3 does adjust status, they can continue to use the K-3 for trips abroad and continue using the K-3 for subsequent re-entries, NO AP (I-131) needed.

For already married couples, the fastest way to be with your partner is through a k3. That has been my experience.

To say that a CR1 is faster is just wrong. Some people argue that with a CR1 there's no need to adjust status upon entering the U.S, that's not

quite the case either since if married under 2 years and the issues of the CR1 is under two years, the CR1 holder MUST file to life the conditional status..prior to beign granted the 10 year greencard.

The only reason, IMHO, to apply for an IR1 VISA is if you have been married for almost two years or longer. In which case, a 10 year greencard will be issued and no adjustment of status is needed and no need to lift conditions of a two year greencard.

In my case, my wife has a k3 approved with multiple entry for two years. Although she does not have a greencard, we intend to process the 130 right around the two year mark so she will be issued a 10 year greencard.

There are advantages to all the VISAs along with disadvantages. But the k3 is definately faster..at least for me and my wife.

We filed both petitions together and both were sent to the NVC for processing. Now the k3 has been approved and are still deciding when to file for IR status...as we both are working oversea.

Just somethign to consider.

Might I add...

The scenarios I just described apply only when both the 130 and 129F are approved and both are forwarded to NVC for processing. Many K3 filers have had only their 129F forwarded for consular processing and their 130 held for future adjustment of status. I don't think the orginal process intended to have BOTH the 129F and 130 petitions forwarded to consular processing. But if you are one of the few people to be fortunate enough to have them both forwarded, then I would pursue the K3 VISA first.

Depending on time factor and speed of 130, you can later decide whether to move with a CR1 ( conditional status visa that requires lifting for 10 year ) or wait close to the two year mark and proceed with the IR1 status ( no need to lift status for 10 year ).

Or, simply get the k3 asap and lift status near the two year mark for a 10 year card.

My opinion, take it for what it's worth.

Your SO can come here probably 30-45 days faster with the K-3. Then you have to jump through more USCIS hoops. As most here will attest, it is not fun. If I went the K-3 route, my wife would be here right now.

I'm willing to spend that time alone, and not deal with having some bureaucrat have our future in their hands. It is a choice. It's kind of a pay now or pay later thing. My attitude is why not get it all done now? Even if it is a CR-1, the only thing you have to do is lift conditions. There is no EAD, or Adjustment of status.

Keep in mind how much fun the K-3 process was when you make this decision. I don't think the EAD will be much more fun.

Many K3 filers have had only their 129F forwarded for consular processing and their 130 held for future adjustment of status.

Or, simply get the k3 asap and lift status near the two year mark for a 10 year card.

Many K3 filers have had only their 129F forwarded for consular processing and their 130 held for future adjustment of status. There was about a six to nine month period where I-130s were being held and only I-129F forwarded. It was somewhat inconsistent but for all of 2008, the norm has been to forward both petitions, just like they did in years past. USCIS implemented this policy without thinking it through, then overcorrected by holding I-129F's when both petitions were approved the same day. Now they've kept only the good part of the November 06 policy change of joining the petitions to be adjudicated together when possible.

Facts are cheap...knowing how to use them is precious...

I think, after entering the US under the K3 visa, and if the EA is not needed, one could eliminate the cost to adjust status and simply move on with a 130 processing, right around the two year mark.

Correct me if mistaken: The advantages are many if the petitioner and spouse are willing to wait near the two year mark to get a greencard...and a 130 is running in the background.

No conditional removal needed.

No adjustment status needed.
