There is a "right" to pursue happiness and this is enforced by allowing US citizens to freely and easily leave the country to find happiness however they wish. They attempt to protect the county by fully screening people that wish to enter. Sometimes they get it right sometimes they don't. Personally I agree with banning drug users as I think much of the general population. Someday federal laws may change in that regard but it won't be soon and it will take years for sub laws such as immigration to catch up with those changes. Until then your right to family reunification exists in your right to leave the US at any time you wish.

This will not be over quickly. You will not enjoy this.

Hi VJ's, I just want to know if the person who posted this issue get approve? I am in the same situation, i had my interview last June 22nd and during my medical exam i admitted i tried drugs last 2003. The consular put me in Under- Review for 8 weeks. Until now i havent heard from them (Embassy). Called embassy last week and they said they sent me a letter wth my passport on it thru post mail.Anyone heard like this before sending passport thru post mail? Thanks!

My husband was denied a visa due to admission of use of controlled substance. He tried it only; there was never abuse. The denial was in 2006. Now that I am a US Citizen (Aug 2008), would it make a difference if I re-petitioned my husband? I’d like to cite my constitutional right to family reunification. Would someone please help us? Our children and I have been away from him since 2004. Thank you!

I don't have any advice to give but to tell you that I feel your pain. My husband had his visa interview early this month and during his medical examination he admitted using drugs 10 years ago. He was told by the consulate that he will be called for the status pending review and until now we have not heard from the. We already are not expecting he will get a visa anymore because of his admission and from what I've been reading in regards to the cases before him. It's devastating but we are trying to move on and make other plans. It will be hard being far from each other but we can't dwell on this but try to look forward for another plans. Good luck to us.

Before you give up U.S visa, can't you just try a last chance talking to a best Attorney available. His drug use was 10 years back, making it as a point.

Before you give up U.S visa, can't you just try a last chance talking to a best Attorney available. His drug use was 10 years back, making it as a point.

Hi I just wanted to stop by and tell you the great news, The 3 year band has been lifted, it is no longer 3 years anymore, it is 1 year, My fiance was denied for admitting to drug use as well. since one year has passed I am now free to apply as soon as I get married. I had to speak to a lawyer and pay $75.00 for a 5 minute conversation to find this out, but it was all worth it. The lawyer said that this was done on a hush hush, and was not publicized, I wonder why? She also explained to me that she has her staff calling back all the clients who were denied, and are in the process of informing them about the change.
