Just to put a side-note on all the things that Kim has mentioned:

When I got my Packet 3, the instructions for the I-134 were that they needed to see:

Letter from Employer

Letter from bank

and/ or pay stubs and bank statements.

They do not ask for tax transcripts from us. You can take them as backup, but they are not a required item, as it is for other countries.

Just wanted to let everyone know :)

6/18/09 - EAD approved and card production ordered
6/20/09- received AP papers in the mail
6/22/09 EAD card arrived in the mail (that was fast eh?)
7/09/09 - received notice of GC appointment date
8/07/09 - Green Card interview at Raleigh Field office at 8:45am - Given RFE for I-693 Vaccination suppliment
9/08/09 - returned RFE to field office. Approved for Green Card
9/09/09 - Received email that Card production had been ordered.
9/17/09 - Green Card in the mail - No more USCIS until June, 2011 :D

Thanks for telling me this stuff. I REALLY appreciate it. I'm glad to hear that it's relatively easy. ^_^

I worry probably more than I should. But it's all good. If I worry about stuff, I'll ask the questions and get the answers, right?

March 13, 2009--Visa application handed to the post office.

March 16, 2009--Visa application received by Vermont Service Centre at 11:01 am. Let's hope that he actually put in everything he thought he did and they don't send it back to us!!

March 23, 2009--Got the whole package back. The cheque was apparently filled out incorrectly, thanks to the fact that his moronic flatmates helped him and instructed him wrong for the first cheque he ever filled out.

March 30, 2009--NOA1

August 12, 2009--Touched

September 1, 2009, received Package 1 from Montreal--but where is our NOA2???

All that matters is if his income right now is enough. In my case, I have not had any real income in over 3 years...I was a student while recovering from a knee injury. 1 1/2 years ago I had a accident at work and was on workers comp for a year. My last 3 years of taxes showed $6000, $8000 and $5000 in income for 3 year. I found a job that I can do with my medical limitations and am making $50,000 a year. Heck I had been working 2 weeks and had a 1 week paycheck when I filed the I-864 and no income for a year and was approved. He should be fine, just make sure his employer gives a statement about his long term potential.

I am very glad and relieved to hear that you had no problems with such a low income. I'm young, 25, and just finished getting my BA a couple months ago in May. I was more or less unemployed during those entire 4 years.

I recently landed a substitute teaching position back in September and, while I do earn the income requirements now, I just hope the fact that the job is "on call" won't cause any issues... :unsure:

Ann has been cheating on me with at least one other guy since arriving here in the US. I took a risk with trusting her and it proved to be a poor choice indeed. Now Ann is back in Bangkok and I have a whole new line of legal paperwork to overcome. Divorce... and rescinding sponsorship with USCIS... Oh the joy! Paperwork to get Ann in to my life and more paperwork to get her out.

And that is all folks. Life sure has a strange way of working out...

Do they absolutely need 1040s? I sending in my I-134, W-2 from this year, and the past 12 months of my LES (pay stubs in translation). Also sent in my statement of active duty service in the military which shows I been employed.

If his income is sufficient there is no need to provide information regarding bank statements and/or assets.

If they decide that he does not meet the requirements then you will be asked to get a co-sponsor. It's not like they just say..."no"....well, not in Canada anyway. ;)

It's also important to understand that the I-134 has no real legal standing. Although fighting a decision based on this would probably take you longer than a new visa. ;) Most Embassy's will use the guidelines set by the I-864 (affidavit filed at AOS) to make their decision. This is one reason why some Embassies are more stringent in their decision making than others.

Been reading. A LOT. I think I've also read the entire USCIS site. O.o That was a boring read, let me tell you. But we looked over all the visas before deciding on the K-1, so it was worth reading. There are very few things I'm not sure of--his income was one and another has to do with the certs they need for my mental health, but I'm thinking I can get those by having an eval done by a psychiatrist (I was treated in inpatient, no follow up care by the admitting doctor and haven't required any care since. Had a counselor at the time, but moved. Need to get my records of admission and stuff from the hospital I was in, methinks.) in my area to figure out what my current "prognosis" is. But I don't think I need that until we get to the point where I have to give the information to the medical people, which is nearly a year off (not that I intend to put it off!).

Stop worrying. He is qualified FIRST by his CURRENT income. On the I-134, state CURRENT income as $27,000 per year and list the employer, include a last 2-3 months check stubs and an employment letter to verify his job. The rest will be "fluff" they will not even look at what he made last year. He does not need a bank letter. State the income, verify it and attach one years tax return. You are fine.

Hi Everyone! My boyfriend has been a cheerleading instructor in the United States for the past 5 plus years and has been self employed. Unfortunately, this has not paid him very highly because he has persued this career for a love of the sport, not the financial benefits.

We are compiling all the forms and documents together, needed to file the I-129F. I am going out to New Jersey in the United States to be with him this summer for three months and we're going to start the ball rolling and mail off the package then. However, I have some concerns about the Affadavit of Support needed and additional documents needed. I have been looking on the USCIS website and through the VJ website and it looks as though the 125% above the poverty line is needed only as his present financial status (not what he has earnt in past years).

Is it worth my boyfriend seeking permanent employment, so we have 'better records' on paper of employment - and if so, would it be ok that he would only be employed for 6-8 months by the time my visa interview comes up? Or shall he just carry on with his self employed job now and when it comes round to doing his tax returns in april 2009, for the past year, show that instead. What do you think will be the best?

Oh and can anyone advise as to what additional documents of proof of his earnings are needed for my interview? Ie - pay slips, bank statements etc... and how many months worth?
