Did not meet through IMB, but attorney checked box, "yes"!!!

According to the definition of IMB, one must pay for the services.

We have filed I-129F for K-1 visa.

But my fiance and I did NOT pay for any services, we met through an online website chat-room, and it was culturally associated, not religiously associated, and we DID NOT pay for any service whatsoever, no membership fees, nothing at all.

But to my horror, now when I go back and review the forms, I see that my attorney has check marked the box for "yes" where it asks about meeting through an IMB on form I-129F.

Will this have a big affect on my case?

Will my fiance be put on AP/AR when the case gets to NVC? I read somewhere on this site that those that checked "yes" for IMB usually have a big chance of the beneficiary being put on AP/AR at the NVC stage.

I don't know what to do, maybe I am stressing for no reason?

Someone with knowledge about this please let me know, I need some direction!

The knowledge I have says that based on what you say the box should have been checked NO. Did you get the opportunity to review the papers before your attorney filed them?

Yes I did review the papers before they were sent, but my attorney said that meeting anywhere online would be considered IMB, especially since the site we met on was a matrimonial site, but again, we did NOT pay any fees whatsoever! We just met in the chat room of that website.

Another reason that I so, so, SO regret hiring her!

What problems could we potentially face because of this error?

I can call USCIS, but I don't know if they will process this correction for me. If I choose to leave it the way it is, will this have the potential to negatively affect my fiance's K-1 application or the process after the NOA2?

I've seen no evidence of it making one bit of difference which box you check unless you also checked a convictions question "yes". Even then it's just a matter of supplying court records.

IMBRA is just something jammed down USCIS's throat. They appear to be doing the minimum the possibly can get away with for enforcing it.

What was the RFE for? Just curious...

Posted

The RFE was for: IMBRA questions that my STUPID STUPID LAWYER...decided to tell me that you can just leave those blank since they don't apply...and plus she used the old I-129F (still acceptable, but there was a newer one when I applied and she should have used that!).

So I fired the lawyer.

And I sent back the RFE response Jan 02, received/resumed processing Jan 06

AND STILL NO DARN APPROVAL!!!!!
