STUCK @ NVC for AP

Just found out I'm in AP. NVC has only had the case for 5 days, but I'm very anxious reading all the "4 month wait" horror stories. I'll wait one week then I'm phoning congressmen, senator, and nvc daily.

I'll keep this post updated, but i did just have one thought. Perhaps they have a certain number of employees doing background checks at NVC and AP is just a way to keep these people busy and employed.

I have not rang the NVC yet to confirm, but we received a letter from them yesterday.

Selected paragraphs:

"This letter is to inform you that the NVC has concurrently received both an approved I-129F petition (for a K-3 non-immigrant visa application) and an approved I-130 immigrant visa petition (for a CR/IR immigrant visa application) filed on behalf of your spouse.

The Immigration and Nationality Act only provides for the K-3 visa classification for spouses of U.S. citizens who are awaiting approval of an I-130 immigrant visa petition or the availability of an immigrant visa. Since your I-130 immigrant visa petition has been approved and an immediate relative visa is available, it appears that your spouse may no longer qualify to be issued a K-3 visa. The NVC will send both approved petitions to the consular post where the adjudication will be made. This letter is just to give you notice as early as possible that U.S. immigration law requires processing under the immigrant visa and not the K-3 visa.

NVC will send you information on the next steps to take to process your spouse's I-130 immigrant visa petition ..."

For the members that have been or are currently going through 'administrative processing (backround check)', does the above sound familar, it seems my case is also stuck in AP? :(

Jan 21 2011 - Approved by USCIS

Mar 04 2011 - NVC received

Mar 15 2011 - Medical

Mar 30 2011 - NVC COMPLETED

Apr 14 2011 - Packet 4 received

May 12 2011 - EMBASSY INTERVIEW

May 23 2011 - VISA received

May 26 2011 - Dulles POE

Jun 20 2011 - GREENCARD arrives

NVC received my NOA2 on 28th February 2011 and it has been stuck there ever since and as much as i would like to think its only going to be for a short while, i have a feeling it will take longer than the actual tine from NOA1 - NOA2 :(

It's encouraging to see that you guys have been in an out of AP *fairly* quickly (compared to 2-3 months). I can only hope for the same. I'm terrified to call now because I don't want to again hear the confirmation that, yes, I'm in AP. But I think I will today or tomorrow and then contact my congresswoman again.

Sending good vibes and positive thoughts to everyone else in AP at NVC!

Don't lose hope yet. Mine was received 3/11 and on Tuesday (3/15) I was told it was in AP. I called again today (frightened of the answer) and they said that on Tuesday (the same day they said it was in AP!) it was sent to the Lima consulate!

so there is still a chance. I think their term for "working on whatever we do here at NVC" might be "AP". Maybe they tell that to everyone but only for some people it actually means something?

I think they tell people "AP" when their case is still at NVC and if it's already been sent they never mention it. That's why I think it's best to wait a couple week to call them.

NVC received ours on 4 March and we're in AP. They said last Friday that it should be sent off to the London embassy early this week, but we called today and they said to call back later this week. Boo! 17 DAYS IN AP and waiting.
