STUCK @ NVC for AP

Well I got more bad news today - after waiting the entire five months for them to approve my November petition - I emailed then called the NVC to find out the status of my application and I now have a BKK # but it is in "administrative review". After I read about Administrative Review I called the NVC back to confirm that I'd been pulled for security screening and the lady basically confirmed it.

I am obviously very upset but I'm hoping someone here can clarify for me since my searches yielded conflicting results. At least one thread said that they could still possibly mail the petition to the embassy, my fiancée could get packet 3, finish her interview, and then she would have to wait for the security checks to clear? Does the fact that I have a BKK number from the NVC help?

Yeah, they gave you an embassy number. That is kind of a good sign. You are probably just having another background name check. They did that to me and I was in AP limbo for a few weeks. Very frustrating because NVC tells you NOTHING. They keep you guessing on status and when you'll be out. Just keep on them (I called everyday), and if it gets too long, like over month, then consider the help of your congressional staffers.

Thanks for the info and encouragement. I actually faxed a form to my congressman, Jeff Flake, yesterday. Up until this point I have avoided getting my congressman involved but I'm a little fed up (the USCIS sat on my application until the VERY LAST day of my five months - it's like they did it on purpose). I know it might not help but it can't hurt. If I don't get any updates I'll contact my Senators over the next couple of weeks.

You should hear back from them before the end of the month. It is impossible to speed up an FBI background check... A senate or congressional inquiry will get a staus report, but can't move the process along any faster... they have been getting them done quicker this year as there has been a lighter load coming through...

You may be right and normally I would agree with you. However, in my experience so far with the USCIS and from what I've read here about the NVC, there seems to be a lot of shenanigans. It appears some people leave Admin Review after only a few weeks (and I thought the FBI check too mandatory 30 days), while some can spend 2-4 months in review. One gentleman here claimed that his was in review for three weeks and then left the day after he prompted his congressman to inquire about the status. It probably won't help but I'm fairly certain it won't hurt.

The duration has decreased in the past months as there have been fewer petitions... its not a manditory 30 days it just averaged 30 days for along time... best of luck... you should be on to the consulate in the next week or two

Well I received a letter yesterday from the NVC saying that my case had been sent to the Bangkok Embassy on May 5th. I had read that people had received letters like this only to call the NVC and find out that their case was still in Admin Review so I didn't take it seriously. However, I called the NVC today and when I finally got through the NVC representative also told me that my application left for the embassy on May 5th. I'm in disbelief because it's only been two weeks since the NVC received my application so I'm not sure if I believe him or not :blink: I think I will call again just to be sure before I celebrate :)

I emailed the embassy and received a very quick response but I'm not sure what to make of it:

"The Immigrant visa Unit is now loading the electronic file of the above captioned case from NVC. Please allow some weeks for us to receive the physical file of the case. Once we have received the completed case files and opened the case in the system, we will notify the applicant by mailing the Packet 3 instructional letter to this address. Please verify."

Can anyone interpret this from bureau speak for me? :wacko:

great news bro.. you are out of AP.. when the case is done at NVC they send an electronic version to the consulate.. the paper copy follows by mail/DHL courrier.... it takes a week or two for the paper file to get there.. then they will start doing what they do at the consulate... you should be getting everything ready for the interview.. paperwork I mean.... check with others in the Thailand regional forum to see what you need to have ready for the interview so you have all of your ducks in a row...

Hey all,

I may be getting ahead of myself here, but in reading the forums it's starting to get a little disconcerting when I see how quickly everyone's cases seem to be sent from the USCIS to the NVC - we're almost three weeks from our NOA2 date and the NVC still haven't received our case. I've read a fair way back in this thread and I can't say it's made me feel any better, haha. Aside from calling every day and bugging the hell of of the lucky soul who answers the phone (which Matt does pretty diligently) we get no real insight into what is going on. He spoke to a relatively nice operator today who said he should email our case number to the NVC and they'll send him an email when our case arrives, so I guess all there is to do is wait. Patience is a virtue, right? Any insight from others who have been in a similar boat would be fantastic. :)
