STUCK @ NVC for AP

ok, I'm confused ... Weeks ago we received a Form I-797, saying our petition is approved and being forwarded to the consulate. But some time after we received that notice, the consulate still doesn't have our petition, so I called to NVC and they said our petition is in AP status at NVC.

Here is my question: Have all of you (or any of you) also received the Form I-797? It makes no sense.

Yes, everyone in AP has received the approval notice from USCIS and the NVC letter saying their case will soon be sent on to the foreign consulate.

It really is too bad that they can't inform you that you are in AP and its ridiculous that they tell you every time you call that you will be notified when you are released when in fact no notice is ever given.

lol crazy! I read your words with interest and amusement! I feel so much the same sentiments... frustration with this process and annoyance with stupidity and inefficiency and lack of empathy I feel when I contact the agencies. I know they have to discover whether we are terrorists or criminals or lepers or indigents, but is it really so hard to discover these things? And here is the basic issue: Let's say my petition (or yours) is the only one they have to process ... then it wouldn't take very long, just a few days. But they are behind because there are so many to process. Then they obviously need to improve efficiency or hire more workers, because if they are 4 months behind due to volume, then they will surely only become more and more behind as time goes on. If I can only pick 20 apples each day, but I need to pick 40 apples to keep current, then what? each day that goes by, I'm 20 apples more away from my objective. Of course I'll never catch up, but only become angry and inefficient and tired.

Ladonna makes a good point. I work for the State of Texas (not a fed employee). We are also behind in processing welfare benefits. Workers are overworked, underpaid and verbally assaulted. One lady last week was attacked by a guy jumping over the counter. It's currently a system set up for long delays and marginal customer service (no competition). Becoming angry, inefficient and tired is the natural reaction to being put in a broken system.:dead: Imagine repeating the same dribble over and over "Beneficiaries name, Date of Birth, Petitioners name, Date of birth, your email is blah@yahoo.com and your number is 123-456-7890. How can i help you" no less that oh 100 times a day? Then some guy/gal yells at them? :girlwerewolf2xn: I can repeat that in my sleep. They really don't have anything to do with delays and their supervisors couldn't care less that they get blown ####### 8 hours a days.

I was stuck in AP for over a month. It sucked big time, my fiancee was in tears when we were on YM video cam. I just kept calling NVC and tried to compose myself. Even asked how the weather was over there after getting the "Still in AP line again". Do be polite to the workers. :thumbs:

Well we are still at NVC ... not sure if is AP or not ...last 2 operators since the "will be sent to embassy within the next 5 days " are saying still in AP and is no time frame - the spanish guy on friday admitted was this update and said had only been one day. But the operator this morning said no - so just asked to speak to a supervisor and surprisingly got one.

She was nice and she said same thing - but when I told her about update - she said yes - BUT they can not tell you anything supposedly UNTIL your application has actually left NVC ?? And this is why we get the non committal replies.

She did hint the update was "real" but since is still there ... she has to say the same thing ..

so am like so confused even more .. and am just going to go back up on my happy cloud and hang on to the "sometime within the next 5 days" update I received and play like this morning never happened :|

Well, let's hope that we wont catch the winter holidays with them. That would throw even more weight on our shoulders, not to mention our loved one that we petition for.

Well today is actually day 36 , not day 42 as I thought. When I called NVC Friday night I confirmed the receive date and it is August 24th. I am trying to be positive and believe that THIS WEEK IS THE WEEK I COME OUT OF AP. I am going to try and test my patience and not call till Wednesday...maybe. I just get so angry now when I call just to hear the same thing. I think if Wednesday there is no change then I will call my Congresswomans office again. Good luck to everyoine this week. Maybe being end of the month they have to get a certain number finished...just hoping.

Why do these things happen to people that follow rules and the law? When I hear "unfortunately there's no timeframe for AP" it just takes the energy out of me and I feel like going home...

I'm in the same boat with you. I've called today, they told me the same thing "Still in AP". They know my voice already. I've been calling them every working day since i got thrown in this AP. I'm up to 31 days now.. :( sad; but if that what takes to be with someone loved, then so be it.

You are right Boghy, I just want my fiancee out of the Philippines specially with the latest disaster that occurred in our home country.

The fact is, we've been lied to, in writing even. I called them this morning and insisted on talking to a supervisor. I asked her politely, but firmly and repeatedly, "Why do you put something in writing that is not true? Why don't you change that letter if indeed it's a form letter?" Who else in this country can get away with putting false information in writing? They would be held accountable in a court of law. It's the basic premise of our legal system. Why put that in writing if it's not true? and not only to do it once, but to repeat the same indiscretion over and over and over? It makes no sense. The supervisor told me to put my complaint in a written letter. I said I would, but she shouldn't think doing so would be an exercise in letting off steam, because I was not just angry but incensed by the incompetence and insensitivity of this practice. They told me to call back in 15 business days. I replied I would write a letter and send it by registered mail, and call back in 2 days, and I would continue calling back every day until I got an acceptable answer. They should not be allowed to perpetuate such behavior with impunity. If I don't have some resolution to this matter, I'll contact my congressional representatives. None of you should accept this situation. They should stop sending us misleading and blatantly false letters, and they should either process our petitions efficiently or give us a reasonable explanation as to why they are being held.

I can't believe it's only been 7 months since we filed ... seems like an eternity!

Totally agree. I've sent an e-mail 4x now and have yet to get a reply. On one of the e-mails I expressed my concern regarding the misleading notification letter. Which is an outright lie for those of us in AP.

I thought i read on a government web site something about they will assign a date to a file and will not forward till that date comes. I kinda took that as maybe they have a certain number (quota) for some country's and that anyone's paperwork over that quota has to wait till date assigned to be forwarded. Does anyone know if this is true or not? I do not have a time line yet but i have been in AP for 25 days now ( sept. 3 ) and just called and still in AP

It took them 12 days to respond to my email. I only sent one. It gives pause for thought to the expression "Snail Mail".

The fact is, we've been lied to, in writing even. I called them this morning and insisted on talking to a supervisor. I asked her politely, but firmly and repeatedly, "Why do you put something in writing that is not true? Why don't you change that letter if indeed it's a form letter?" Who else in this country can get away with putting false information in writing? They would be held accountable in a court of law. It's the basic premise of our legal system. Why put that in writing if it's not true? and not only to do it once, but to repeat the same indiscretion over and over and over? It makes no sense. The supervisor told me to put my complaint in a written letter. I said I would, but she shouldn't think doing so would be an exercise in letting off steam, because I was not just angry but incensed by the incompetence and insensitivity of this practice. They told me to call back in 15 business days. I replied I would write a letter and send it by registered mail, and call back in 2 days, and I would continue calling back every day until I got an acceptable answer. They should not be allowed to perpetuate such behavior with impunity. If I don't have some resolution to this matter, I'll contact my congressional representatives. None of you should accept this situation. They should stop sending us misleading and blatantly false letters, and they should either process our petitions efficiently or give us a reasonable explanation as to why they are being held.

Totally agree. I've sent an e-mail 4x now and have yet to get a reply. On one of the e-mails I expressed my concern regarding the misleading notification letter. Which is an outright lie for those of us in AP.

It took them 12 days to respond to my email. I only sent one. It gives pause for thought to the expression "Snail Mail".

What a great list that is! Wonderful job, thank you. Everyone stuck in NVC should check out Thantita's list... It won't help you get out of NVC, but at least you can see the company you're in... I notice we're the only K-1 filers from Italy stuck in NVC ... :blink:

Interview ... WAIVED? Never heard of this, but they didn't even interview him, just told him pick up his visa the next day.

Current Status: Interview ... waived ... I guess :) They just took his fingerprints and documents and told him everything was in order and he should pick up his visa tomorrow! WOW

I can't believe it's only been 7 months since we filed ... seems like an eternity!
