Hello everyone,

I am totally confused.. Please help!!! We got our both approvals for CR1 and K3 a couple of days ago. But we don't know which one we should go with.. After getting NOA2 is there too much time difference between K-3 and CR1??? How long K-3 takes and how long CR1 takes??? Some people say if i go with CR1 I'll get in the state in 5 months... Is that true??? :( Many thanks!!!!

CR-1 has additional processing at NVC (I-864) and (DS-230 + document processing) so tends to take longer still.

However, if you use the NVC shortcuts posted on VJ, you may be able to get the CR-1 through NVC before K-3 interview, and get the K-3 dropped in favor of the CR-1.

CR-1 has the BIG advantage of an INSTANT green-card upon entry to the USA, the K-3 has the added pain of AOS to get green card.

For the most part CR-1 tends to take a bit longer than K-3 to get if you prepare for NVC when they request I-864 fee, and Visa fee, as well as documents requested by NVC. In many cases the CR-1 petition reaches the consulate just before K-3 interview, which causes K-3 to get dropped and the interview becomes a CR-1 visa interview.

K-3:

I-130: $355

I-129F: NONE

Consulate: $131

AOS: $1010

($1496)

CR-1

I-130: $355

NVC I-864: $70

NVC Visa fee: $400 ($355+$45)

($825)

I see many posts from K-3 holders stating, "Wow this sucks, I am stuck at home because I don't have EAD, DL, etc, or I am having hard time getting added to bank accounts because of NO SSN." K-3 has a 90 day or longer period of limbo while waiting for EAD or Green-card.

K-3 was developed at a time when CR-1 was taking much longer that today, NVC has greatly streamlined the CR-1 process to the point where K-3 becomes irrelevant.

One last note: Keep the CR-1 moving, and if you get K-3 interview, try to reschedule the K-3 interview to allow the CR-1 to catch up.

If done correctly the CR-1 will only take a month or so longer than the K3. It's DEFINITELY worth the wait. You eliminate all the cost, hassle and stress of adjusting status that goes with the K3.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

your cr1 might catch up with the k3. If you research the nvc steps you can do it in a month average, some people were approved in less than a month. My cr1 was completed in 42 days (I even received an RFE). Good luck

  • I-130 SENT 2-19
  • NOA1 RECEIVED 3-03
  • I-129F SENT 3-14
  • NOA1 RECEIVED 3-21
  • NOA2 RECEIVED 10-11
  • NVC CASE COMPLETE 11-21

I would go with the CR1,

Your K3 petition will get to the consulate within a couple of weeks usually. However, you have to do a packet #3 before they will schedule your interview. Then they will give you packet #4 which is requesting everything that you will have to give the NVC for your CR1.

The fastest most effective way is to go through with the CR1, Get the orginal Police Record(s)(english) Birth Cirt (Orginal and english translation) Orginal Marriage Cert (English Translation) and DS-230 Parts I&II (only Part I, page 2 is signed) from the beneficiary -FEDEX Get all that in the petitioners hands. Get your I-864 and I-134 completed along with the supporting docs that go with that. That way after you get the letter from the NVC to pay your fees (do on-line if you can, only takes a few days and then you can print out the bar code - instructions are in the NVC letter) You send the Avid of Support Bar code fee along with docs I-864 and I-134 and supporting docs to NVC and Visa Fee Bar code with supporting docs- orginal Police Record(s)(english) Birth Cirt (Orginal and english translation) Orginal Marriage Cert (English Translation) and DS-230 Parts I&II that go with that. Fedex or UPS them in separate envelopes to avoid confusion to NVC.

You save over $1,000 dollars and hassel going the CR1 route. Everything that you have to do for the CR1, you still have to do for the K-3. Only real difference is where and who the documents are given. If you get everything you need and send all the correct docs to the NVC for the CR1 is is not that long. Some of us however, learned the hard way and got RFEs from NVC because we missed something. Keep in mind, you could still go the K3 route and be missing the required docs that would still delay the visa if you are not careful. At least with the NVC, they don't complete the case until they have all the correct and right docs. Therefore, there should be no worries about that during interview. The difference between interview possiblities are averaging one month.

Thank you for reading my novel. I think we VJs should colaborate and write and book. :reading:

Have any more questions, that is what we are on this sight for, to learn and share.
