Does it matter if the beneficiary is employed or unemployed? Is there a possibility that you get denied because of the reason that you are unemployed??

Unless petitioning for a work-related visa, I've seen no evidence of a foreign fiancé/spouse being denied because of not being employed. :thumbs:

I agree with Karin and Otto... I have never seen a denial on a Fiance',spousal Visa because the Benenficiary was unemployed....

I agree with Karin and Otto... I have never seen a denial on a Fiance',spousal Visa because the Benenficiary was unemployed....

As long as the petitioner through the AOS can prove that the beneficiary will not be a public charge to the US government, then I see no reason for denial. The beneficiary though may be subject to subjective scrutiny during the interview process. The CO is empowered to to use both objective and subjective means to decide the final outcome of the case. (Who knows what inside the CO's mind?) But then again as long as all documents are in order and there is a bona fide relationship, I really see no reason for denial. :)

It doesn't matter if the beneficiary is unemployed or not. What the CO is more concerned of, is whether the petitioner can provide for the beneficiary and not resulting to the beneficiary being a public charge to the US government. So the petitioner must prove that his income is 125% above the poverty line.
