Okay. So I was told to fill out an I-134 for my husband to take with him to his consular interview. (I'm the American and he's in Ireland.) No problem. But I'm just wondering that since in the instructions for the I-134 it does not say that my income tax returns are needed, should I still send a copy of them along with all of the other verification to my husband? Or should I just send the form along with my bank and employment verification as is? I was also told that I have to submit the I-864 Affidavit at the same time. And I know that in the instructions for the I-864 it does require me to submit my income tax returns. So...help!!!

Most consulates in their P-3 directions specify US Citizen's IRS returns or transcripts.

Example:

Form I-134 Affidavit of Support: The I-134 Affidavit of Support is required for returning residents (SB-1), fiancé(e)s or spouses of U.S. citizens (K1, K3), children of K1 and K3 applicants, spouses and children of lawful permanent residents (LPRs), applicants with special immigrant status, and follow-to-join derivative family members of employment-based (E) applicants. A copy of the sponsor's most recent Federal income tax return (Form 1040) should accompany the I-134. Faxed copies of the ITR are acceptable.

l. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed]I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner's ability to be financially responsible for you. You should also submit your petitioner's most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

The directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Thank you so much for clearing that up for me! I'm waiting for a cimple copy of my income tax returns form 2007 to be sent in the mail. I'm just getting so antzy since we're almost there! Thank you again for the help!

A simple copy of your return is not going to be comlete because it won't evidence the income. You need the complete return including the W2's or 1099's. What's simplest and will suffice is tax transcripts. They're free. Just google IRS transcripts or call the IRS and request they be faxed. You'll have them in a few minutes. Request the last three for good measure.

Yes, you need to attach your income tax info. If you do not, they will make another appointment date for "additional forms needed" which will push your date for being together out that much further.

I like transcripts the most. Consulars will accept copies of transcripts, which can be faxed from IRS in just minutes.

If your income is above poverty, you might only need a transcript. One year is all you need but 3 years is bullet proof evidence of

income stability.

Regardless, I would include a copy of letter from employer to showing ongoing employment.

All others like bank statements, 401k, real estate, etc.. can be helpful to those living at or below poverty. If such case pertains to you, it might be

advantageous to show liquidity or ability to show that the assets can be easily sold for cash if need be.

I know people that have many assets including copyrights, life insurance, patents, personal jewelry, and personal items valuing up to hundreds of thousands.

Yet, without sufficient income evididnce and prior year evidence of income, the consular rejected.

**** filed K3/CR1 concurrently. My wife and I both work/live overseas. The following timeline continues from the approval of the K3 VISA.
