Ok everyone this is the question, My wife is From Guatemala and we are now living in NY. We want to adopt a 7 year old from Guatemala but want to know if we can get around the American adoption process by adopting her in guatemala as Guatemalans and than just filing the I-130 as her parents. What does everyone think?

According to USCIS...

Q: Can I adopt a foreign-born orphan and bring him/her to the U.S. without involving the USCIS?

A: No, there is no way an orphan can legally immigrate to the U.S. without USCIS processing.

It all depends on Guatemalan laws and restrictions. I know that in Colombia they have very specific instructions on people who want to adopt and are living abroad since agencies from both countries are involved in the process. I don't think you can get around this since you're currently living in the US and saying otherwise would be considered lying on the application, don't you think?
