Hello, my friend is in the the States,

Hes been there for 3 years now. So he has just renewed hes work permit for next 10 years.

Problem is, recently he lost a job & hes marriage started to crumble for a lot of reasons.

Is it possible, for him to leave for around a year? He does not have a USA passport. Does he need to fill in a form, so he can get back in?

He would love to return to the States to live.

Thank you for any help & i will pass this on to him asap.

First of all what permit or visa was he on? That makes a big difference. If it was work based and he was no longer working there he is out of status and needs to either get another work permit/visa/status. Is he married to a USC? If so did he file for AOS? This is too vague to answer at this point.

In regards to leaving for a year, that will pretty much invalidate any work visa/permit/status including that of the Green Card. He would have to re-apply for a new work status when he wanted to come back to the US. A Green card you can leave, but you may easily be denied since you are not supposed to be out more then 6 months. Special circumstances are allowed, one which can preserve your Green Card as long as conditions are met etc. But first, we have to know exactly what work permit he is on?

May - Met future wife at arts fest

Nov - Recieved 6th TN

2003

Nov - Recieved 7th TN

Jul - Our Wedding

Aug - Filed for AOS

Sep - Recieved EAD

Sep - Recieved Advanced Parole

2004

Jan - Interview, accepted for Green Card

Feb - Green Card Arrived in mail

2005

Oct - I-751 sent off

2006

Jan - 10 year Green Card accepted

Mar - 10 year Green Card arrived

Oct - Filed N-400 for Naturalization

Nov - Biometrics done

Nov - Just recieved Naturalization Interview date for Jan.

2007

Jan - Naturalization Interview Completed

Feb - Oath Letter recieved

Feb - Oath Ceremony

Feb 21 - Finally a US CITIZEN (yay)

I don't think there is such a thing as a 10yr work permit so please check with your friend if he meant that he had a green card. If he has a green card, then he can leave the US and re-enter just using his valid passport (from his native country) and the green card. But, he should not stay outside the country for a year. If he plans on being out of the country for a year or more, then he will need to get a re-entry permit. All this is of course based on the assumption that he has a green card.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!
