I need HELP Please. ANybody who has same experience. I have 2 kids from my ex girlfriend. I married my wife last year here in the Phils., she's from the US. She petitioned me last year and I passed my medical test and I got interviewed at Manila Embassy last week. I passed the interview, paid Visa fee and got my pink slip with 2 conditional requirements that I need to submit which are 1. Marriage Ceritificate from NSO and 2. Birth Certificate of my 2 children, as my wife put them as her stepkids on the application form I-30. I got the Marriage Certificate from NSO (no problem). I got my children's birth certificates but PROBLEMS are: 1.) Mother name has my last name 2) it is showing a date of marriage even though there's no record of marriage between me and my ex-GF (mother of my kids) in NSO.

Now, I am scared to submit the birth certificate of my kids as they might ask why my ex-GF has my last name (she registered under my last name, we were supposed to get married in 1989). and also there's a date of marriage

showing in the BC. What do you think? Are they still going to investigate these docs? I already have pink slip, does that mean I dont need to worry?

Oh? How can she used your last name if YOU DID NOT GET MARRIED? Is it legal?

Hello Swwet Wifey,

In the Philippines you can use the father/mother's name in the kids birth certificate with the marriage info on the certificate (like my kids situation) but as long as you are not legally married(NO NSO record of marriage) you would have no problem at the embassy. They looked at my kids birth cert. when i was interviewed and got approved.

What you need to do is submit their real birth certificate ..truth will always come out and you will do fine as long as you can prove to them you were not legally married to your ex. They looked at my kid's birth certificate when i was interviewed and i had no problem. Just did not bring my kids yet but they were in my k1 application as k2.

What you need to do is submit their real birth certificate ..truth will always come out and you will do fine as long as you can prove to them you were not legally married to your ex. My brother is in a similar situation. His daughters birth certificates also have a date of marriage. Back then that was the only way to get his daughters follow his Last Name. Right now he is in the process of going to court and getting it published so that they could put a note on the birth certificate that he is not really married. He only filed correction for one of his daughter's since it cost 35K. But I'm glad to read your reply that there's nothing to worry about as long as he is truly unmarried. I had posted his situation here for quite sometime now and never got any reply. I even tried contacting a couple of lawyers hoping they can give us some advice on what documents we need to prepare but no luck there either. Did the consul ask for any specific document to prove it or is cenomar from NSO enough to prove it.
