Just to let you know my husband overstayed his visitor visa by 6 years , he entered legally in 4/2001 and stayed we adjusted without an attorney or supplement form. We had our interview in 8/2007 see my timeline

Not sure that since you spouse is from Mexico if that mkes a differnce as long as he entered legally

4/14/10 Email approval for 13 yr Old CR 4/23/10

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

05-05-2008 Received NOA1 - VSC

11-05-2008 Received Notification of Transfer - CSC

11-12-2008 Touched

11-13-2008 Touched

11-14-2008 Touched again :-)

11-26-2008 Touched - could we be getting close?!?!

11-27-2008 Touched - indicating I-130 Approval!!! Thank you God

12-01-2008 Received NOA2 Approval Notice

NVC Process:

12-05-2008 AOS & Fee Bill sent to attorney

12-16-2008 AOS & IV Bill received from attorney

12-17-2008 Paid AOS & IV Fee Bill online - Status "In Process"

12-18-2008 AOS & IV Fee Bill status "PAID" and Cover Sheets printed

12-18-2008 Notice on NVC AVR that Packet of Info & Documents Generated

01-05-2009 Completed & Sent Affidavit of Support

01-26-2009 Completed & Sent DS-230

02-02-2009 NVC recieved Checklist

02-09-2009 Case Complete at NVC

02-25-2009 Found out that 1st appointment is on April 2nd

04-02-2009 Went to 1st appointment in Ciudad Juarez & eligable for waiver

06-02-2009 Had I-601 waiver appointment in Ciudad Juarez

06-04-2009 Notified by DHL that we were backlogged - told to wait 15 months

Currently waiting on an answer and to bring hubby home!!!!

How does the NVC get involved in an AOS case?

Correct me if I'm wrong -

Your husband is already in the US, right? And you got married while he was on overstay? He is still here?

The correct path to legalize his status here is to file an I-130, I-485, I-485 Supplement A with all the documentation showing validity of the marriage. You can also file for I-765 while the I-485 is being processed. What I am hearing you say is that you have filed and gotten an I-130 approved. What does the I-130 approval notice say? It SHOULD say that the beneficiary is residing in the US and will be adjusting status. I know my friend did this last year for his wife and she didn't leave the country, go back to mexico, and have to get a visa, they did a straight up AOS with the $1000 penalty.

This appears to be a straight AOS from "other" status, meaning it does not belong in the K3 forum at all

I'm moving this to the K-3 forum but i'm not sure that's where it belongs.

Yes my husband is already here is the US. He has been here for almost 8 years i wanna say.

The only application i filed was the I-130. To Tell you the truth i dont know what the letter says i have not received it yet.

On the USCIS page it only says to follow anything that the letter tells me. I will probably get it today since they sent it on Dec 1st.

That's OK. I would caution you that your husband should not leave the country, for any reason, until the AOS papers are filed, processed, and approved. Good luck to the two of you!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
