Trying US Immigrations again.

Timeline

We are thinking of trying the US immigration again. I had brought my now husband down on a K-1 visa the first time. We were married Aug of 2007. But all went bad from there. Not with us but our so called Immigration attorney. So my husband was fed up with the attorney and went back to Canada. I was also. He has been back there since Aug of 2008. Now I have been hired on at a federal job and don't want to quit to move up to Canada with him. So we decided that we will try again.

My question are; Has anyone ever tried this before? Should I file I-130 or I-129?

I am wondering if we are going to have a hard time with this. We have all the papers from the last round on how our attorney messed up. Like telling him he could work with out a work permit. US gov was not happy!!!!

Any help would be greatly appreciated on this

In general, starting over with a spouse visa process is just a matter of doing it. However, if he's got a record with USCIS for working illegally, that brings up a whole other can of worms. What's up with that?
