renewing temp resendcy card

my wife has a resendcy which needs to be renewed its been 2 years she has a paper now which allows her to travel for 1 year we paid a fee but didnt send any proof where we are living.8 months ago i retired and we moved to costa rica with our family thinking it would be permanent and we would get travel visas for the family when traveling stateside.we have found costa rica has changed for the worse and isnt the same lovely place we once knew.we will probably move back stateside in the next year or two.we dont want to loose the residency status for my wife and kids.my wife has been spending time in the states to make good face.I want to go to the embassy in c/r and explain our story and be honest and see what can be done a lawyer in n.y. is telling us to get divorced in the states telling immigration's I cant be found (which i think Is crazy)can i just explain our story honestly to the embassy here they are well aware there have been major problems in c/r in the last 3 years
