Has anyone been denied at a POE trying to visit while K3 is being processed?

When entering through Dublin, you indeed do immigration there and customs in the US. That applies for VWP travelers coming on holiday, as well as entering the US with your visa.

That is how we did it when we came over with Wes' K. And every time Scotty came to visit Saxony on the VWP, he cleared Dublin.

Other ports of entry may do things differently, but that's the way it is when you travel through Dublin.

Dublin is also the VJ-famous POE that turned Liam around with his approved K-1 visa for lack of a proper waiver.

Interesting. Thanks for the correction, you two. :) That news made me curious so I looked up preclearance centres and apparently the two in Ireland are the only ones like that.

CBP currently conducts inspections of persons applying for admission in 13 overseas airports. These ports include Aruba; Bermuda; Freeport and Nassau, Bahamas; Dublin and Shannon, Ireland; and Calgary, Toronto, Edmonton, Vancouver, Montreal, Winnipeg and Ottawa, Canada. CBP staff at most of these stations, other than Shannon and Dublin, complete full CBP (immigration and customs) processing. Staff at the Shannon and Dublin locations perform CBP-Immigration processing only. Flights from these two ports are cleared for CBP-Customs and Agriculture at their destination ports in the United States.

Maybe the OP could fly through Canada and if worse came to worse, they could have a short vacation together.

What Tracy is suggesting is that IF one was turned back at Dublin, at least one would be turned around before a long trans-Atlantic flight. One would still be out the fare, but at least not physically exhausted as well.

If you make it through Dublin you are homesafe. You won't get turned at your US customs clearance. Unless of course you are carrying contraband.

Hello,

Does anyone know the implications of getting turned around at the airport?

Would we have to start the entire visa process over again?

Or would it have other negative side effects on our current visa application?

Could I try it later on at a different POE again?

Thank you,

Michigan

Michigan,

It depends.

Generally, if someone is refused entry for immigrant intent (the most common concern for ppl here at VJ), there is no negative consequence for their immigrant visa application.

Trying different POEs (do you have a Canadian in the family?) depends again on what happened at the first attempt. There are certainly some POEs that are 'easier' crossings, or, a border agent may say 'you don't have any proof you'll return to Canada. Come back with better proof or a visa'. In that case, the visitor could re-apply at the same, or another POE in short order and be successful.

Or, the agent could say 'forget it. Do not come back for 6 months or without a visa'. In that case, a note is often made in the file and it's a good idea to go along with what the agent told you.
