I have alot of questions... I will be calling the USCIS on Monday

IR-1/2 vs. K-3/4 ?

DCF? (as I still have a address in Canada)

Fees?

Processing times?

I-130 for all ?

on the I-130 it says (relative already in US as visitor?? So does this mean they can come down as visitor then start the I-130??)

Interviews - Do the kids have to go with the Wife?

Since you live in Canada, DCF may be your only viable option. If so, K3/K4 is out of the picture. You'll be in an IR1/IR2 process. Canadians are allowed to visit the USA but you already know that. Depending on ages, yes, the kids go for interviews with their mother in Montreal. Then, they enter the USA with IR2 visas.

Since you live in Canada, DCF may be your only viable option. If so, K3/K4 is out of the picture. You'll be in an IR1/IR2 process. Canadians are allowed to visit the USA but you already know that. Depending on ages, yes, the kids go for interviews with their mother in Montreal. Then, they enter the USA with IR2 visas.

If he lives and works in Arizona, he can't apply for DCF. He needs to file an I-130 for his wife and kids.

5.05.08 - EAD Card Production ordered GOT EMAIL (we received the same email on 5.09.08)

5.13.08 - Approval Email for EAD (so the card was ordered first, and then we were approved...hum)

5.15.08 - EAD Card Received in mail.

8.08.08 - WE GOT OUR INTERVIEW APPOINTMENT YAY...9/12/08 - INTERVIEW APPROVED

9.24.08 - Received Green Card in the mail YEAH!

Looked into the CRBA an i came across this... If your child was born on or after 11/14/86, and only one parent was a U.S. citizen at the time of the child's birth, the child may have acquired U.S. citizenship at birth if the U.S. citizen parent was physically present in the USA for periods totaling five years prior to the child's birth, at least two of which where after their 14th birthday.

Then your children will need visas. They are not entitled to US Citizenship through you.

Yes, if he no longer resides in Canada, DCF is not an option. He'll file I-130's for each immigrant and send them to the Chicago lockbox for processing in California. They'll interview for CR1 and CR2 visas in Montreal.

As a Canadian LPR with a home in Canada though, he may still be able to file DCF, which will be faster. Of course, his family can visit during the process as long as they don't stay too long.

Working in Arizona probably means sleeping their but not necessarily "residing". I've worked a lot of places I didn't reside.

Just called a hotline to help with filling out the I-130 form. I have been advised that I only need one form for my wife & 3 kids (as they are oour kids)?

It looks as though I am going to try as a DCF in toronto

Do all the family need to go or just me?

One petition for all is dead wrong. We don't call it "the misinformation line" for nothing.

If filing for K3, you can get by initially with only one I-130 and one I-129F but you cannot do K3 visa DCF. DCF only works for immigrant visas which require an I-130 for each intending immigrant. Perhaps the person you talked to assumed your children were US Citizens but you know they are not.

Even with K3 each immigrant needs their own I-130 eventually, but you can file for the kids later. I don't reccomend it though.

Looks as though I will not be able to get to the US Consulate to DCF, so I will be mailing the I-130 Forms for each family member, wife & 3 kids. from my understanding I will also submit a check for $355 USD from a US bank per form? This would be for a K-3 Visa Correct? When filling out the I-130 there is a plus sign a few sections (Middle Names are too long) is this okay to submit this way? I really would like to get this all together and really have no clue.

I-130 petitions would result in IR1 and IR2 visas in your case. K3 and K4 require an additional filing of an I-129F for your wife, after you have a receipt for her I-130. Additionally, you would need to file to adjust status for each immigrant after their K3 or K4 arrival at $1010 each depending on age. The earlier recommendation you received was to file for immigrant visas. That's the IR1 and IR2. There's a guide here specific to that. I suggest you study it.
