Hello All. I would like to hear from all those who's significant others have gone through the interview and have been ok'd for the waiver. My husband migrated to America around September 2001. From his account, he was caught crossing the border 4 times before actually crossing. On all 4 times, he was fingerprinted, photograph and return to Mexico with the same warning not to attempt to cross again. We met on 03, had our baby girl on Dec 05 and got married on July 07. Because his father is sick on February 08 he left back to Mexico. His Case was completed on Nov 26th, 2008 and I was told by the customer agent to call next week in order to get an Interview date. Now my question is this, will he be eligible for the waiver, has any one in the similar position (refering to the turnaround at the border) that have gone to the interview at the consulate and been granted the waiver, or worse denied? Please get back to me with this info. I want to believe that he would get the waiver and that everything will be okay, however I also want to hear from others. Thanks for your responses.

Depends on what they indicate about the denial of entry, if it was at the normal POE, then this is only counted as denial of entry and simply is not a factor on an immigrant visa.

A waiver probably will be needed for "Overstay"
