Recent I-130 Approvals (Nov. /Dec.) - NVC Process

guess we made a mistake at the I 130.. we have to file i 824.. another 6 month of waiting. this kills me. i just want to quit.

i dont understand...form I-824 is not meant to correct mistakes. if there is an error in approval on part of USCIS, you have the right to request expedite processing...you are missing details here..please share details so we can help...quiting is not going to help..you have to find a solution to the problem...it should not take 6 months...i highly doubt it...unless your case is in AP at NVC then it may take a few weeks not months...thanks!

Well from what I read on the forums here is ,that we might have answered something about question number 22 wrong and this is why they keep our approved I 130 at uscis till we sent the I 824 and money to reqest them sending our I130 to NVC. I tried calling them and asking about it but I can't even get a someone on the phone. I was hoping i could tell them our mistakes and they'd say, "ok, we'll just sent it to NVC". Te timelines say that the processing time is 6 months for sent I 824. Another 6 month of wasted life and waiting. Sorry but thats all I know.

i am soo sorry!!! hopefully they will be able to clear it up faster, it would be horrible if you had to wait another 6 months!!!

Thank you. I guess it's our own fault for not answering their questions right. I hope it wont take 6 months but for now the processing time says so.

how did you answer question 22? if USCIS approved your petition without making sure the guidlines for the NVC then its their fault. if you put in that your spouse is in the country (when they are not) and will adjust status then it is your fault and you will have to file I-824. regardless, call your congressman and ask for assistance. good luck!

LingLing - DS3032 hasnt been generated yet for me...when do you think it will happen? my case is moving awefully slow :( i am going to india next month and want to be done with NVC before i leave.

1 to 2 weeks is normal. Just keep calling everyday...once in the morning, once in the evening.

As soon as you hear that it's been generated, you can send your response letter with COA.

I believe you have everything else ready to go...right?

For India, I believe the PCC must have been issued within 6 months.

I have everything ready. the PCC is valid for one year from the date of issue and must be valid on the date of the interview. i verified this both on mumbai consulate website and delhi embassy website.

LingLing - can you please update your guide section 11 b with the photo requirement to be sent to NVC. i dont see it there. you also mentioned that there are two photos required for the medical. not sure why it is part of your guide. can you please let me know if u put that on there on purpose? thanks!

For some reason, I can't get to ANY .gov sites

I think it has to do with my "hot-wired" cable modem. I'm getting like 26mb down...but that's another story.

Anyway, CMNB, feel free to update the Wiki as needed.

As for pix for the medical...my understanding is THAT'S how they can know that the doctor examined the correct person.

ya but my wife doesnt have to submit the medical pics with the DS-230? or does she? thats what i am confused about.

i don't think my husband will contact anyone. I guess we'll just pay for the mistake. I don't know how we answered the question...

btw - does anyone know if you can re-schedule an interview? i have a trip planned to go to Ireland in March - with my luck my interview date will be while I was supposed to go to Ireland =/

I think so. When it gets scheduled, I would call the Embassy and ask.

We got a February 26 interview date from the Mumbai Consulate for the K-3 interview. Not pleased with the lateness of the date but I guess I made it in before they schedule March. Hoping that I may be able to get a better interview date through CR-1 process.

Has anyone ever received an interview date from the NVC that was earlier than the one given by Consulate for K-3?

ok guys, my case number has been assigned by the NVC.

Desiman - call NVC and see if yours is assigned as well.

Hey cmnb, did you talk to someone or the AVR says they received it? I called just now and that stupid thing still says "No record". I'll call again to see if someone can tell me if they have it. I got it till midnight to bug them! Thanks for the update.

...and as expected, a nice lady, told me to allow some more time. So back to the week of January 4th.

thats weird... i hope your case gets there soon..why dont u call VSC and see if it has left their office.

i called and spoke to a very unpleasent guy. oh well, who cares if he was nice or not.

They received my case Sept 24 at the NVC and my stuff was completed on Dec 1 and the AVR never recognized my file.

I did not send photocopies...I really hope I don't get an RFE for it, that would just be silly

so got an RFE - on the I864 - should have it submitted again tommorrow - found out by calling them

I did however find out that they are scheduling interviews NEXT week for Feb :)

hopefully we can get this in and approved to have an interview by then :)

There is still no case of mine at NVC. How long does it take NVC to receive the case from USCIS?

Mine took 12 days. But it took me from the 12th of Sept until the 30th to discover they had my stuff since I didn't show up on the AVR.

*sigh* nope! :wacko: lol :innocent: I promised my husband I would call again tonight to see if they have scheduled it. I did call last night and nothing yet. I didn't realize this IS THE 2nd week in Jan already. :blush: So at least I hope I hear something soon. My phone bill last month was a bit pricey from all the times I called the NVC hoping for an interview date. My initial completion date was Nov 20, but then they answered my email with the PCC attachment afterwards and it bumped my completion date out to Dec 1! Talk about a really hard lesson to learn! I hope yours is quick and that it fits perfectly with your vacation to Ireland. My sister is getting married on Valentines Day and I hope that I can attend her wedding... so either before or after is what I am hoping...
