Recent I-130 Approvals (Nov. /Dec.) - NVC Process

Hey,

Yes, they should have your I-130 too. If it is not in the AVC, try an operator tomorrow.

For the I-129F, you should check to see if it was forwarded. This can only be done by talking to an operator, as the AVC is never updated to reflect what's going on with the I-129F (b/c NVC does not hold the I-129F for long). Given that they said they received the case on 12/29 my gut is that they sent it on 12/31 but I would try to reconfirm when they sent it with the NVC.

The State Dept uses DHL to ship their packages. Once you confirm the date that the I-129F was sent, you can go on the DHL website to approximately track your case. There are forums here talking about it but I'll sum it up below.

1. Go to: http://www.dhl.com/publish/g0/en/eshipping.../sref.high.html

2. In Shippers Reference, enter the info as follows:

EXP DD MMM YYYYA

EXP is constant

DD is the date before the day the NVC said they shipped the case.

MMM is the three letters representing the month the NVC shipped the case

YYYY is the year the NVC shipped the case

A is constant

For example, if the NVC says they shipped the case on January 2 2009, this would be entered as "EXP 01 JAN 2009A".

3. Date range for shipment - From: Enter the date of the day before the NVC said they sent the case

4. Date range for shipment - To: Enter todays date

5. Account Number: Keep Blank

6. Shipment Destination: Select India

7. Once you enter the info, press "Start Tracking"

8. After a while some info will appear giving you the waybill number of the package and where it is.

Based on my belief that the NVC sent your case on 12/31, it appears that the case is still on the way, and should probably get there tomorrow or more likely Tuesday. Let me know if you need any help.

There is a good news on my birth certificate, there is a law under registration of Birth and Death in India, in case of dicrepancy in the orignal records, If both parents and two Gazetted ( Read Government) employees give an affidavit stating the correct Date of Birth, corrections can be made in the register....

Call up NVC and talk to an operator...Thats what I did, actually Isent my DS3032, sent and signed to by husband the day I got the case number...Then I called NVC EVERYDAY to check if the AOS bill, and DS3032 was genrated.....I was told it was generated...and mu hubby sent the DS3032 immediately by overnight express.....

So just keep calling:)

Other option is to call Dept. of State (202 663 1225. Press Option 1 then Option 0) and ask the agent whether your I-129F case has been received by the consulate. They should be able to tell you what's going on with the case (ex: received by consulate, packet 3 sent, packet 3 received, packet 4 sent, interview date etc).

Most likely, it should already be at the consulate and packet 3 should have been sent.

Thanks guys for help. It just gives me chills when both agencies say they don't have it.

Two more questions:

1. If they cant' see my case manually or through AVR, it doesn't necessarily mean they don't have it. It might be there, but not in the system at all due to holidays?

2. Is it true that the AVR only updates on Tues. and Thurs.?

I checked the DHL website and it looks like they've sent my K3 on 12/29/08 and is in transit.

Wait I am a bit confused by that link, if I am reading it correctly it is asking for 2 copies of our certified marriage cert???

here it reads like this from that site.

so are they asking for 2 copies???

is your question about submitting I-130? or submitting docs to NVC? i am confused. coz they dont ask for petitioner's information...the DS-230 application for an immigrant visa has to be filled out by the beneficiaries and requires document from the beneficiary.

So, I got a letter from NVC dated 12/29/08 that they have received my I-129F and within a week they will forward to the embassy. Funny thing is the operator as well as AVR say they don't have it! Anyway, should this also mean that my I-130 is with NVC too? FYI: Both were approved the same day.

Desiman - they should technically have your I-130 at the NVC also. unless they held it back and only sent your I-129F (the way they traditionally have been doing in the past). i would check with USCIS and NVC and have them give you the "location" of your case.

cmnb, any idea on how their traditional way of forwarding worked? If so, the timeframe? Curious.

Good point Siyaram, I forgot about this. The State Dept number is especially helpful, particularly in the case of Indian filers. The only practical way to contact the Mumbai Consulate is through e-mail (they have a phone line but it's always busy) and they've been taking time to respond to e-mails with the holidays. The State Dept number will give us the information we need in our local time.

1) Yes they could still have it and could not have been scanned by the NVC yet because of the holidays, but I'm surprised that they wouldn't haven't scanned it after this much time especially given that they scanned the I-129F. Has an NVC operator confirmed that they haven't received it?

2) I used to believe that the AVC only updated Tues and Thurs but I know that the AVC status of our case changed on Saturday after NVC received our AOS and IV docs on Friday so I am not sure what to believe so I just check the AVC every day for curiosity's sake.

Desiman - traditionaly they used to approve the I-129F first (the K3 way) and used to hold the approved I-130 until the time the non-immigrant (K3) visa holder would come to the US and adjust status. which was the main purpose of the K3 visa to avoid any delays at the processing at NVC. they have recently started to approve both the I-130 and I-129F together. so there could be a posibility (very unlikely though, given their recent trends) that they are going back to their traditional way of holding the I-130. USCIS would be in a better position to answer this for you. but, when you call USCIS dont mention anything about your application being held....you dont want them to hold it even if they didnt plan to. i would call both agencies and talk to their supervisors and demand to know what the location of your file is and that you are aware of a lot of cases approved after you that have already been assigned a case number at the NVC. they have to stop giving you the runaround at this point.

i would also wait for this week and see if there is any movement or else get your congressman involved.

Thanks. Yes, i did check with two different operators this morning and they both said the same thing. They suggested I call next week WT*? It has taken forever. Sorry if I sound paranoid, but this drives me crazy.

This is just frustrating. Call everyday to talk to an operator at NVC. According to me, why wait for this week to get over? Draft a letter for congressman and send in middle of this week. They take couple of days to contact anyway. I really hope that your I-130 gets into their system fast.
