Recent I-130 Approvals (Nov. /Dec.) - NVC Process

Timeline

Even though it says the 2nd and 3rd year are optional, I've seen people here on VJ get an RFE for not sending them. I'm not sure why they would put "optional" on the form and then generate an RFE, but they have been doing it. I think it's best to send all 3 years.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

You may be referring to the "Stupid RFE" where people don't enter in the amounts for the 2nd & 3rd year,

or failed to file for the 2nd & 3rd year, and did not send an explanation.

I can personally vouch for success in sending current year only.

cmnb, i used I-864EZ since my income was well above the poverty line and didn't need to show anything else. I highly recommend it IF your income is significantly above the poverty line. The reason I say this is because if the income is marginally above the poverty line, you may still need to show additional assets to show that you can support your spouse.

cmnb, i used I-864EZ since my income was well above the poverty line and didn't need to show anything else. I highly recommend it IF your income is significantly above the poverty line. CJ, I understand your point. If you'd like to write a section (guidelines for what form to use/when) it will be very much appreciated.

Personally, I think individual circumstances are too broad to make suggestions beyond the current guidelnes...but it sounds like you're up for the challenge.

For instance, I'm a business owner with considerable assets. My tax return alone would indicate that I'm barely able to afford gas for my car...but the strength of select assets made my ability clear.

Hey, what we could really use from you is a section on how to get your income well above the poverty line....and not pay more taxes. :)

Just send in your tax transcripts. That's enough. I sent the last 3 years worth of transcripts, but you may send only this years and other two years are optional.

now about the other guide about being well above poverty line and taxes, i can't tell you anything about that. I promised Mr. Madoff that I will keep his secret... ;-)

I had ordered my tax transcripts on the phone and had received it in 2-3 weeks. Its easy ordering process and they are free. You can order today itself and then wait for them. Meanwhile, you can have a backup plan of having your returns ready just in case your transcripts don't show up on time. I am sending transcripts as well as returns even though transcripts would suffice.

Sounds good...but I think it might be better to enhance the existing guide with your experiences, as appropriate.

CJ - my income is significantly above the $17500 number. i will just file the 864EZ. i think i can be safe filing this form. plus the EZ form is very EZ to use.

There is a good news on my birth certificate, there is a law under registration of Birth and Death in India, in case of dicrepancy in the orignal records, If both parents and two Gazetted ( Read Government) employees give an affidavit stating the correct Date of Birth, corrections can be made in the register....

I am just praying that I get my DOB Certificate by wednesday
