I'm getting ready to send out the first K3 packet today and I was wondering about evidence of a bonafide marriage. My wife and I talk everyday on vonage and on MSN with webcam and such. I have screen shots of our conversations on MSN with both of us on webcams and I have a print out of my vonage bill, averaging about 4000 minutes a month :). Is this enough evidence or should I include something else? Also, copies of marriage and birth certificates, could I just copy those on a scanner or do I have to call the county clerk office to get official copies. Thank you for the help.

Its unclear what 'packet' you're sending out - but according to the GUIDE under assembling the package, it lists the following as possible evidence:

Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financial resources; or

4. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of

the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your

marriage); or

6. Any other relevant documentation to establish that theres an ongoing marital union

that doesn't apply to people who don't live together. just send in copies of your marriage cert along with pictures of the wedding and reception. marriage license. you may want to add a notorized letter from a family member or other witness that states they witnessed the wedding. talking and chatting online doesn't prove a marriage took place.

Always read carefully and interpret literally. USCIS DOES NOT require what you've put in bold above. They suggest the petitioner SHOULD include one or more of the items in 1-6 above. Most newlyweds that have never lived together can realistically only provide items that fit number 6, like communication evidence and evidence of visits. However, all our anecdotal evidence shows newlyweds who haven't lived together can simply ignore the suggested additions and supply a photocopy of a government issued/certified marriage certificate.

When chosing to included affadavits, make sure they focus on the relationship, not the wedding. For newlyweds this can be entertaining since most people won't know much about the relationship except you looked like you were eager to begin the honeymoon or, if they were lucky/unlucky they heard the hearboard banging from an ajoining room. I'd just skip the affadavits. They aren't needed.

we included proof of trips my husband took to visit me, and affidavits from my room-mate (who witnessed our relationship from the beginning, both over internet and during his visits, because he was my guest) and from his boss (who knows all my husband went through to get free days in order to visit me, also knows my husband spends all the coffee/lunch breaks at work skype-ing me, because the time zone difference). every case is different, of course. we didnt include leters from parents, because i havent met his at that time, and they live on the other coast so was obvious they dont keep an eye on my husband or his daily life, and my parents dont speak english, and we avoided translations and so on.

DS 3032 sent : 26 dec 2008 (friend sends it, based on how fast Ds-3032 was generated for Sracastillo and others who had same NOA2 date as me-risky, but worked)

my husband goes back and bags with our papers get lost : 5th jan 2009

case complete: jan 20th

interview march 30th 2009

up to this day, no package received at embasy here -one more reason to prove in my case I129F was just useless

Those sound like wise choices, given your circumstances.
