My co-sponser backed out in fear of having to pay for Kai. I make 16,292 a year. Will this be enough to get him home I just have me and Kai only to support. He will be going to Sydney AU consulate. We have been through HELL to get him home and I am bawling so hard right now.

Tell your co-sponsor that the I-134 is form over function... it is not legally binding....

It is the I-864 that comes later when applying for the greencard that is the binding contract

What does the AU consulate look for 100% or 125% of the poverty level?

If its 100% then you will just make it. If it is 125% then you are a little under.

Do you have any assets to make up the difference? ($3 in assets for every $1 short).

Hon you need $17500, you can make up the difference with assets but I think that might be $3 to every $1 short, hopefully someone else will be able to shed more light on it.

I dont know if you can get a part time job to make up the difference, or they might take a view on it as you are not that short

I hope you sort it out, and someone with more knowledge on this will be able to help you more

Maybe have Kai call the US Embassy in Australia. I know that the Embassy in NZ said to us that if we were within $5000 of the amount needed we wouldn't need a co sponsor. Some Embassy's are less strict than others. Good luck!

my checks show I make close to it

but I only have one tax return because i did not work for 6 years

can I also use my SSI that i still recieve each month????????????

The Sydney consulate is really good (and quick) about responding to emails. I'd write them, explain your situation and see if you will need a co-sponsor. Don't bother calling them, you wont be able to get through to anyone who will help with k-1 questions.

I believe that SSI is counted as income on your tax return. So that would be in addition to your wages. If that is so, then your wages + SSI(assuming it's more than the $1200 shortfall you indicated) would get you over the hump.

Do a search here on VJ reagrding the SSI. I would bet that situation has been experienced by someone else. When asking the embassy give them all the info needed to give you a good answer.

Don't give up. Think BIG PICTURE and tackle the obstacles. It's worth it!

when you file taxes you cannot include ssi... because it is actually a form of welfare
