waiting for I130 with K-3 visa in hand?

Well I got approved for both I130 and I129F K-3. My files have been forwarded to NVC. I haven't received any conformation on I130 from NVC, but I got a letter stating that my I129F has been forwarded to the consulate in India. My question is that if my wife should pursue K-3 or wait or I130? I was thinking maybe she should go through the K-3 process and get the visa and just wait of the I130 process to go through. Is is possible or her to do that?

I want her to come here on I130 because she would get the greencard. But I don't want her to loose this opportunity of K-3.

K-3 petition is only valid until march. If NVC delays my I130 then she can come on K-3. If she waits for I130 and not pursue K-3 then the time will expire.

So, my question is basically can she get the K-3 visa approval and wait there for I130 visa?

On my understanding,I130 approval could be approved by the time she's already here in the USA,and also in some cases like i had,i got both petition approved in the Philippines.If she has her K3 visa,she could come to the US and wait for the I130 approval here then proceed to AOS.If someone knows here that's better than my undertanding-pls respond

You dont sound like you are aware of what happens next at NVC to get the C R 1. If not study the guides to see the flow chart for NVC action on the documents. It can take months to get thru NVC even if there are no RFEs.

The CR 1 is the best visa because it comes with Green Card & doesnt require the AOS procedure later.The K 3 will require the AOS , related expenses & time wait to get the Green card which is months.

She can not get two visas so you must decide which one you want. If you want her to be here more quickly take the K 3. Since NVC has forwarded the docs to the Embassy she will now recieve packet 3. Sending that back will result in packet 4 which is the interview date letter. If she doesnt respond to packet 3 request they will put the case on hold. If you decide you dont want to K 3 its a good idea to notify the Embassy of your intentions.

No need to worry about petition expiration dates. It's a non-issue. Consular officers simply extend the validity as needed. Get over to the CR1 forum and find the latest method for speeding the I-130 through NVC. The best case scenario is to get the I-130 to the Consulate before the K3 interview and use the K3 interview date for the CR1 visa. If you want a CR1 visa, get over there and learn the CR1 process instead of hanging out in the K3 forum.

I've been there and done it and I have helped many people through the k3 process. In fact, I was one of the few to have received approvals on both the 129 and 130 petitions in about a month's time. I even mailed the petitions together directly to the CA center. PUSHBRK is correct about the petition expiration date. My wife and I were fortunate enough to have our k3 in hand/interview quickly. For some their petitions expired way before the interview date. I've never heard of anyone that experienced problems associated with an expired petition.

THE ACTUAL PETITION EXPIRE DATE IS THE ONE PRINTED ON THE APPROVED VISA which doesn't matter anyway since you will have the VISA by then. Ignore the one on the 129 approval letter. Your petition expire date is important only if you want to correct or udpate information related to your 129 petition after receiving your VISA. For example, you might find out after the fact that some information about you or your wife were entered incorrectly and wish to update. This would require you contacting the embassy to correct. Otherwise, don't worry about it and let it expire.

In our case, we chose NOT to enter the U.S. and are still living together oversea, due to jobs being oversea. Actually, my wife's petition will expire way before she enters the U.S but her k3 visa doesn't expire for 2 years.

It is my understanding that with a k3 visa in hand, we can consider whether to continue through the NVC process and adjust status when she enters the U.S. or request to have the approved 130 processed through the local embassy for a fee.

Remember there are several dates that are critical.

- petition approval date IGNORE

- petition expiration date on petition approval letter -- IGNORE

- k3 interview date == IMPORTANT

- k3 visa pick up date -- IMPORTANT

- petition expire date on visa -- IGNORE

- visa expiration date -- IMPORTANT

- 1 94 expiration date - IMPORTANT
