filling out the w-4 form once married---is k1 wife a nonresident alien?

Hi,

As part of adding my wife to the health insurance, my employer sent me the w-4 form for my 'review and update.'

I was going through all the fields, and question 3 on the w4 form has three checkboxes with the following options:

single, married, maried but withhold at higher single rate.

Right below the checkboxes, it says

NOTE: If married, but legally separated, or spouse is a nonresident alien, check the "single" box.

That 'note' kind of stumped me! :blink: Since my spouse is not a resident, I'm thinking of checking the single box, but I find that odd....

How have you guys responded to that question?

2009-01-12===> Sent AOS packet via UPS
2009-01-13===> AOS packet received
2009-01-28===> NOA's received in the mail
2009-02-01===> Biometric appt received in the mail
2009-02-06===> Completed biometric appt thru walk-in
2009-02-06===> Applied for expedited AP thru the phone
2009-02-14===> Received AP in the mail
2009-02-11===> Case transferred to CSC
2009-02-23===> EAD received
2009-05-02===> Green card received in the mail, no interview done.

It is all about the rates at which taxes will be withheld from your paycheck and nothing about being legally single or married....

no hard and fast rule .... it all depends on your individual tax situation

Most people check "Married". :thumbs:

She's not a nonresident alien.
