Timeline

So let me get this straight... She'll have her EAD in like 60-90 days and will be authorized to work and has a SS Card in her madien name and that's all fine but we can't change her name on her SS Card for like 2 years!!!

That's nuts.

So getting her added to my bank accounts, getting her a State ID (until she can actually pass the test and get a drivers lic) are all just that much harder because NOTHING on our marriage lic says diddly about her last name being the same as mine.

Bunk.... BUNK I say!!!

What is with these people

It sucks...but you have to wait until after you receive your green card. They won't make any changes to it if you aren't currently eligible to obtain one. It's just like when I changed my name I had to prove my citizenship (I'm the USC)...I already had a card, but I had to prove I was still eligible. It would be too easy to marry and lie your way into a new SSC otherwise.

07/29/07 ---- Mailed I-129F

08/25/07 --- Check finally cashed (8/27 I should be able to see the R number on the back).

08/27/07 --- NOA1 Arrives from CSC and I create my account profile on the USCIS.Gov web-site (the clock starts)!!!

02/05/08 --- After 191 days NOA2 (Approval) comes at last!!!!

2/14/08 --- NVC sends letter saying that it's on the way to the US Embassy in Bangkok

2/25/08 --- She receives Packet 3 from the Embassy

3/29/08 --- She receives Packet 4 with interview date (July 11th).

3/30/08 --- I e-mail the Embassy asking to make the date earlier because I've already got our tickets for June 13th!!!

5/6/08 --- No help from the Embassy. Rebooked tickets and vacation till September.

5/21/08 --- Embassy calls her and moves interview to May 27th!!!!! You have got to be kidding me!!!

9/21/08 --- POE San Francisco!!!!

12/8/08 --- Married!!!!

12/15/08 --- Mail AOS + AP + EAD package to Chicago

12/28/08 --- Come back from vacation and find AOS/AP/EAD NOA 1 and Bio App notices in the mailbox!!!

1/13/09 --- Bio Appt

4/22/09 --- AOS Interview "APPROVED"!!!

3/04/2011 --- OUR BABY IS BORN... We have a son!!!!!

3/10/2011 --- Mail I-751 application to lift conditions on residency

I misspoke...she should be able to do it once she has her EAD. But...I'm confused. Why would it be like 2 years? K-1/K-3 green cards have about a 6 month timeline from what I understand. In fact, someone said in another thread today that it usually takes 1-3 months after you're transferred to CSC before your AOS is approved.

I am not changing my name, I have kept my maiden name and had no problems being added on to my husbands bank account, or getting a drivers license. As long as I proved we were married and had my SSN # (didn't need to show the card) it wasn't a problem. I don't think you need to have your husbands last name in order to do those things.

Issue isn't having my last name (I'm the usc and the husband) it's having documents with her "new" last name on it so that it's much easier to get her added. You should see the stuff you need here (Michigan) to get a state issued ID card.

Worst case that I've heard about is 2 years.

All I'm trying to do is get legal documents with her "new" last name on them and it's proving to be a real pain in the butt. Here's a good example... we registerd her for ESL class at the local community college and since we had just moved into town I couldn't "prove" that we were residents (at least not to the satisfaction of the clerk) so I paid non-resident and we walked away... well my wife ripped me a new one on the way home and couldn't understand the rules. So after thinking about it a minute I realized I had a really good case for an exception since I grew up in this town, hell I even graduated from the community college in question, and had paid taxes here my whole adult life except for when my employeer had me out of town on work assignments (years at a time). So I want back in with the purchase doc's from the house we just bought, my elect bill, my cable bill and my charm and guess what.... I got the resident rate. So they processed the refund and the check showed up in the mail today.

It's in her name.... her "new" last name that she doesn't have any id for and that we can't get any id for. Not a big deal I know.... just sign the thing and deposit it in my bank. It's the point of the whole thing.

She is just as entitled to the SS Card that she has now as she was when she got it issued... all I'm trying to do is update her name. Okay so I'm 44 years old and no one has EVER asked to see my SS Card. I know it's not that big a deal. I'll open a joint bank account at my bank... it's just a pain with out any good id in her new name

I understand your frustration...I really do. However, right now, she is NOT entitled to an SS card. She fits into a loophole that allows her to keep the valid one she has, but as soon as that I-94 expires, she is technically out of status...which means she is not entitled to anything (for example...if she leaves the country, they won't allow her back in, because she is out of status and not allowed to be a resident). If you had gotten married right away and applied for a change in name while her K-1 had more than two weeks left on it, they would have allowed it...no problem. But as soon as it expires...all of that goes away. The foreign spouse is now out of status and only allowed to stay based on their pending AOS application.

A little late to the game but as they always say, better late than ever. We are December filers as well and just went for the Biometrics appointment this morning.

I am just now skimming this topic as I had an occurrence I thought odd and wanted to see if anyone else had this happen as well.

Submitted and received everything fine in December. NOA's arrived and Bio Appointment letter, even and RFE, all arrived with no problem. Then today, I received and email from CRIS stating that on Jan. 7th the post office returned two notices they tried to send to us. We have not moved and have been checking the mail on a regular basis, has anyone else had this experience?

Sort of. Our most recent notice had a note on it saying to "try" our apartment number. They had left off the last digit. Thankfully someone wrote that note on it otherwise ours would have been sent back too. I called to advise there was an error and I'm hoping they will fix it.

All the other notices were correct before so it just looks like a clerical error.

Maybe its just me, I find this weird USCIS shows last touch on 01/07/2009 but the biometrics letter is dated 01/09/2009. Maybe someone could enlighten me.

Did the letters come from the National Benefits Center or the Service Center? Maybe they have different databases and your data was inputed wrong at the Service Center. My wild guess. I would call and make sure everything is ok.
