Hi list,

Our I-130 is still not approved but in the mean time my wife has an opportunity through her employer to come US on a Business visa, since she is a potential immigrant how does Embassy treat this?

Do they issue her Business visa if she apply for it, is it worth going through this?

If the Visa is rejected do they stamp in her passport? how does it effect I-130 process and what kind of questions does she has to face when the time comes for her spousal visa interview.

Please share your views.

I am not 100% sure of the answer to this but I do know that work visas are non-immigrant visas which may be difficult to obtain if she has already declared immigrant intent by applying for th I-130. Plus, I do know that one cannot hold 2 classes of visas at the same time. So once her CR-1 visa is approved then her work visa may be in jeopardy.

My husband has a business visa. This area is not black and white. Some people travel on them while waiting for this process to complete and some choose not to. We decided against it, because you are really not suppose to have immigration intent when using a business visa. We didn't want anything to mess up or more so DELAY our process. However, some people use it and nothing happens. I would say the best advice I can give you is to call the National Visa Center and ask them. I have the Department of Homeland Security and a Washington Visa Center phone number that has given me some good info. IF you would like it to call them , message me and I will send it.
