usually from what if seen on this forum for k1 visa sponsor or co sponsor u just have to show 2008 tax return or copy of w2 im pretty sure he will get w2.......the other things ur talking about is when u do change of status im sure someone will tell me if im wrong but when u do change of status its more involved your dad should be back by then ............anything he makes after dec will be on his 2009 return they are only interested for the interview the 2008 and possibly two years before that if he does not earn enough good luck

Hello, thank you for giving us the advice. Although, I don't quite understand. Are you saying that all we need is my dad's (co sponsor) 2008 tax return and no other evidence other than the I-134 form. I am just a little confused because of how the I-134 form says to provide bank statements, letter from employer, letter from bank stating when it was opened and current balance....ect.

Could you explain what you meant please.

well yes u should get the letter from his employer but from what i have seen if the income is enough they dont ask for anything else......if it was u that was doing the I 131 i believe they do ask for it..... its the adjustment of status from what i understand that these other items are needed and required......once again im sure that someone will correct me if im wrong

Everyone has give you a good list of what you and your father will need to provide for the I-134. You will need this for the interview in London which won't be until next summer. Him being away will make it more difficult but can easily be done. Just as a little pick-me-up, the UK embassy is a "relatively easy embassy". They basically look at the form, make sure you are above the 125% poverty line for the number in the house plus immigrant and move on. This is not the major sticking point you seem to be afraid it is, just go ahead and file and you will get the forms in order.

Here is a plan.

You finish High School, enroll into a Community College in your area, get your Associate Degree in Nursing, takes little over 2 years.

Sit for you NCLEX and become as Registered Nurse in USA.

You will earn good income and only have to work a few days per week. You will be able to sponsor yourself for K1 Visa, and you will also have a education to fall back on.

Timeline

Many Americans won't file their 2008 income tax returns until late in the year. They will get an extension of the April deadline because they are out of the country, or their CPA is too busy to meet the deadline, or some other reason accepted by the IRS.

So, your father can do everything before he leaves-- using his 2007 return instead of 2008. Filing the fiance petition now will get the process going. When USCIS approves it sometime around March, that's when your fiance will need the co-sponsor package to provide the embassy at the time of his interview. The 2008 return will not be an issue.

You are both better served if one or both of you develops some marketable job skills before getting married. Your marriage will stand a much better chance if the two of you are able to maintain some financial stabillity without the help of sponsors. I understand you want to be with each other now, but what is the point of starting sooner if it means a greater chance of ending soon? Certification programs to learn networking or telecom don't take that long to complete, and he can earn a pretty good living with that. If it's really forever, then what's the rush?? You can then follow the K1 process and bring him over here.

First off this post is a mixture of visas but I decided to put it in this topic because we are still looking into the possibilities left for the K-1.

Hello, my name is Deanna. I am an 18 year old female who holds a United States Citizenship. I am currently finishing my last year in high school. I obviously do not have a degree in anything. I am not individually wealthy but do have people who could co sponsor me in the United Kingdom and Untied States if allowed. Also, I am able to receive a few grand to place in my account if needed.

Now that I have told you about myself I will tell you a bit about my fiance.

My fiance, Luke is a 23 year old male who holds a British Citizenship. He doesn't qualify for any skilled working visas for the United States. He just has his general education just like me. He is the same financially. He has someone who could sponsor him in the United Kingdom and United States.

Our goal is just to be together. We would love to get married and live together. We are trying to find any visa that would suite us. UK or US.

Now with that being said, we have looked everywhere and looked into MANY visas. We have spoken to people on forums, immigration lawyers, immigration helplines, called US and UK embassies and have studied both US and UK government websites. We first Luke applied for a B-2 tourist visa. This would buy us 6 months in the United States when he would come to visit me. He was denied this visa under section 214( b ) [lack of ties to the UK].

Then we were going to do the UK fiance visa. The UK fiance visa is no longer accepting Co Sponsors so we would have to prove Luke could support me. We have been over it and it doesn't look too bright. He just got a job working for O2 [Cellphone company] he will be working 38 hours a week. Also, we found out that they have changed the age requirement from 18 to 21 just recently.

Then, we looked into the newly added UK temporary work visa called the Tier 5 Youth Mobility Scheme. This would have suited us perfectly as we would gain all the points need in this point based system. The only problem is, the United States is not included in the scheme. :unsure:

Finally, we looked into the K-1 fiance visa for him to come here and would allow us to get married and then Luke would apply for permanent residency. This visa allows co sponsors. We were going to have my dad co sponsor us but all plans broke apart when finding out he will be in South America in a military base working on planes. He will not be able to get the supporting documents for us. If we do go this way we wont have 2 months of supporting documents as he would have to collect them early before he goes in february.

- good idea or no?

We don't know where else to go from here...

Is there anything we could apply for, either to buy us time together or to apply for a visa that would allow our lives to begin together without those sad goodbyes. :cry:

We've been through a lot and have hit rock bottom. We need every bit of help as possible.

I don't believe the OP was asking for advice on her relationship...

Your dad's info should be as current as possible for the Embassy to review. There has to be a way for him to get the info he needs to you from wherever he is in the world. You can email/fax/snail mail from anywhere. He and you will both need a notorized I-134, letter from employer stating income is ongoing, paystubs and tax transcripts. As stated, if he meets the requirements, he will most likely not need bank statements or proof of other assets.

Each Embassy can be very different in the requirements so your best bet is to contact the Embassy directly, explain your situation and get an answer from them.

This is the exact route my Dad has taken. He has been a nurse all his life and has passed his NCLEX and even had a job offer for a hospital in California. This was in March 2006. He is still not in the US.

I can see the value of a trade but I don't really want to go 2 whole years only seeing my fiance for short visits.

We want to be together and though some people may say 'why rush you have your whole lives', well we love each other and we want to be together! Not seeing the one you love is a very difficult thing to do as I'm sure many here on VJ will understand as they too have done it. We don't want to be apart any more than we have to be. I don't want to start my life until we are together. For me love comes first before anything else. That's just the way I am, may sound immature or silly but it truly is the most important thing to me. I am working in a job now that I enjoy but I am not happy. The reason I am not happy is because the girl I love is 4000 miles away and I have not seen her for 50+ days.

Well I just hope we can get all this sorted. Deanna is getting her passport picture done today and also ordering a cheque book as she does not have one. We are very close to submitting out forms and are going to work at making sure we get all the evidence we need for the I-134.

I would like to thank everyone who has commented on this topic as it has really given us some food for thought. Also, seeing everyone's timeline and seeing how long it's been since loved ones were together, yet they are still going strong and not giving up hope is really inspiring.

To make an example, my fiancee is 24 years old. We submitted an Affidavit of Support or I-134. Attached were his tax transcripts for 2007, 1040 2007, W2 2007, recent pay stub, letter of employment. That's it... no bank statement, no land titles, no house title, etc etc...

Ok, that is all very useful information. Thank you. I will definitely take all this information and use it for our try to use it for our co sponsor I-134.

It'll all work out somehow.

Thank you for your first comment. As I just read Luke has cleared things up about the "advice on relationship" comment from above. Although I would like to thank them for taking the time to read and respond. The information you gave sounds like the right path for me. I am just going to try to get EVERYTHING done as close to when Luke needs it. I'd rather have extra information than lack information.

Thank you for the pick-me-up. I love when you get those when you feel you're completely lost in this process ha. I enjoyed reading your response. It made me feel more relaxed. There are people who give you loads of information and people who give you a little "You can do it" cheer and they are both so nice to read.

Just as a thought, as a way of 'getting to be together' quickly, but have you considered au-pairing once you graduate? There are LOTS of professional families who would jump at the chance of a native english speaker who wants to be in the UK for a couple of years (the maximum is 2 on an au-pair visa) and who is already 'established' with acquaintances so that they'll not be hanging around the family over the weekend?

You'd have to check it out, but I think that you might be able to file for a K1 from the US whilst working in the UK or at least start it from there while you're still here and time things so that you're back in the US when it gets processed. Since you'll have a co-sponsor anyway, it's less of an issue regarding income, etc.

My SO just spent 5.5 months in the UK and not only did it confirm to us who was immigrating where, but confirmed that we can live together without killing each other AND gave him an understanding/ insight into the british culture that has really helped us with little quirks that he was putting down to me just being wierd, when actually it's me being english! lol.. Like getting to grips with our very ironic/ sarcastic senses of humour.

You're only young once and this is the sort of opportunity you'll be too settled to have once you're married! This is what I'd be doing if I didn't already have a kid :))

Haha. No I haven't looked into that visa. I have heard of it but didn't like I qualified. I will definitely look into it.

Luke first came here to the US for a month in july 2007 and then came back to the US October 2007 to January 2008 and I flew back with him staying in the UK until end of April 2008. That was 6 beautiful stress free months. We got along so well no fight very few tiffs. He's my best friend and it works out perfectly. Then he came back to the US June 2008 to September. I flew back with him to the UK to stay until beginning of October. In the time I spent in the UK with him I fell in love with his family and your silly "driving on the wrong side of the road". He lives in North Wales and it is so beautiful there. People are very friendly unless they are working haha. I love it there I really do. At the time of my last stay we were planning to apply for the UK Fiance Visa. I was stoked! We found a really nice place to have the wedding and everything. Now that our plans had to be shifted to the US K-1 visa I'm a tad disappointed but all that matters is that we are together. Our goal is for both of us to have dual citizenship some day.

Anyway, thank you for informing me of that option. I will look into it!
