What are our options!!?? Please Help

First off this post is a mixture of visas but I decided to put it in this topic because we are still looking into the possibilities left for the K-1.

Hello, my name is Deanna. I am an 18 year old female who holds a United States Citizenship. I am currently finishing my last year in high school. I obviously do not have a degree in anything. I am not individually wealthy but do have people who could co sponsor me in the United Kingdom and Untied States if allowed. Also, I am able to receive a few grand to place in my account if needed.

Now that I have told you about myself I will tell you a bit about my fiance.

My fiance, Luke is a 23 year old male who holds a British Citizenship. He doesn't qualify for any skilled working visas for the United States. He just has his general education just like me. He is the same financially. He has someone who could sponsor him in the United Kingdom and United States.

Our goal is just to be together. We would love to get married and live together. We are trying to find any visa that would suite us. UK or US.

Now with that being said, we have looked everywhere and looked into MANY visas. We have spoken to people on forums, immigration lawyers, immigration helplines, called US and UK embassies and have studied both US and UK government websites. We first Luke applied for a B-2 tourist visa. This would buy us 6 months in the United States when he would come to visit me. He was denied this visa under section 214( b ) [lack of ties to the UK].

Then we were going to do the UK fiance visa. The UK fiance visa is no longer accepting Co Sponsors so we would have to prove Luke could support me. We have been over it and it doesn't look too bright. He just got a job working for O2 [Cellphone company] he will be working 38 hours a week. Also, we found out that they have changed the age requirement from 18 to 21 just recently.

Then, we looked into the newly added UK temporary work visa called the Tier 5 Youth Mobility Scheme. This would have suited us perfectly as we would gain all the points need in this point based system. The only problem is, the United States is not included in the scheme. :unsure:

Finally, we looked into the K-1 fiance visa for him to come here and would allow us to get married and then Luke would apply for permanent residency. This visa allows co sponsors. We were going to have my dad co sponsor us but all plans broke apart when finding out he will be in South America in a military base working on planes. He will not be able to get the supporting documents for us. If we do go this way we wont have 2 months of supporting documents as he would have to collect them early before he goes in february.

- good idea or no?

We don't know where else to go from here...

Is there anything we could apply for, either to buy us time together or to apply for a visa that would allow our lives to begin together without those sad goodbyes. :cry:

We've been through a lot and have hit rock bottom. We need every bit of help as possible.

just because DADDY is working in south america does not mean he will not file a US tax return. and besides... if you file now you are about June 2009 before an interview in London, should be plenty of time for daddy to gather docs

Sorry, my DAD will be in South of America for 6 months. That would make him coming back around August. Can't go in the blindly and not know if there will be a slight chance of getting the documents needed.

If he gets the documents in advance and writes a letter signed and notarized and gets a letter from his employer signed and notarized stating that he will be in South America during this time and had to collect all the supporting documents of the I-134 early would that work?

He simply needs to provide his 2008 tax return.... seems a lot more trouble getting a letter notarized indicating he will be is South America than just doing his tax return.... He can file using turbo tax from South America just as easy as from Podunk, Iowa...

Well if can't he do his tax return before he leaves in January? What is going to be difficult is he needs to submit a years bank statements, a letter from his bank showing his amount in his account, when the account was opened and get a letter from his employer stating he is employed and is making such and such a year. He cannot access these thing as he will have to stay within the military base. That's why I suggested a letter from his employer stating he is going to be in South America from this date to this date and a letter from him stating this is the reason why he collected the documents early before leaving.

Well if can't he do his tax return before he leaves in January? What is going to be difficult is he needs to submit a years bank statements, a letter from his bank showing his amount in his account, when the account was opened and get a letter from his employer stating he is employed and is making such and such a year. He cannot access these thing as he will have to stay within the military base. That's why I suggested a letter from his employer stating he is going to be in South America from this date to this date and a letter from him stating this is the reason why he collected the documents early before leaving.

Is his income insufficient? If he lacks income then and only then does he need asset information... I think they have telephones in South America, I am sure he can call the HR department from his company and request a letter... In addition, I assume he gets paid from time to time... I assume he gets a check "stub" that shows YTD earnings... this can be used in lieu of an employer letter if the HR department won't answer the phone..

You are making this a lot more difficult than it really is

usually from what if seen on this forum for k1 visa sponsor or co sponsor u just have to show 2008 tax return or copy of w2 im pretty sure he will get w2.......the other things ur talking about is when u do change of status im sure someone will tell me if im wrong but when u do change of status its more involved your dad should be back by then ............anything he makes after dec will be on his 2009 return they are only interested for the interview the 2008 and possibly two years before that if he does not earn enough good luck

Please... we have all been through the "stress"... If the stress causes you to not think clearly you need to stop and take a a breathe...

BTW, I did already... A signed notarized I-134, His 2008 tax return, his 2009 YTD pay stubs, dated closer to the actual interview date....

OK, thank you. Is the I-134 the only document that needs to be notarized and I'm not sure if you'll know this but will he receive his 2008 tax return in South America? I have read on other posts that a tax return is not required when you have other supporting documents.

Sorry to make things complicated I would just like to know my options and what would be best.

I-134 is the only notarized document

He will file his 2008 tax return with the IRS in the USA (either by mail or electronically)... He only needs to provide a COPY of that return that he filed...

usually from what if seen on this forum for k1 visa sponsor or co sponsor u just have to show 2008 tax return or copy of w2 im pretty sure he will get w2.......the other things ur talking about is when u do change of status im sure someone will tell me if im wrong but when u do change of status its more involved your dad should be back by then ............anything he makes after dec will be on his 2009 return they are only interested for the interview the 2008 and possibly two years before that if he does not earn enough good luck

Hello, thank you for giving us the advice. Although, I don't quite understand. Are you saying that all we need is my dad's (co sponsor) 2008 tax return and no other evidence other than the I-134 form. I am just a little confused because of how the I-134 form says to provide bank statements, letter from employer, letter from bank stating when it was opened and current balance....ect.

Could you explain what you meant please.

He was saying that your dad's income is sufficient- above the poverty guideline, then there's no need to show assets like cash in bank and other properties. There are ways to show proof of income in the Affidavit of Support I-134... tax transcripts, 1040, W2, pay stubs or employment letter. That simple.

To make an example, my fiancee is 24 years old. We submitted an Affidavit of Support or I-134. Attached were his tax transcripts for 2007, 1040 2007, W2 2007, recent pay stub, letter of employment. That's it... no bank statement, no land titles, no house title, etc etc...
