I just came here in the US last November 22, 2008 under the K3 Visa. I've read in the forums that you need to get an EAD first before getting an Social Security number. Knowing EAD takes time (45-90 days), my question is: Is there any way that I can get my Social Security number without the EAD? I would want to learn driving here in California and later on get a driver's license. Thanks for any insights you might provide.

The only valid nonwork reasons are:

-- Federal statute or regulation requires that the alien provide his/her SSN to get the particular benefit or service to which he or she has otherwise established entitlement;

-- State or local law requires the alien who is legally in the U.S. to provide his/her SSN to get public assistance benefits to which the alien has otherwise established entitlement and for which all other requirements have been met.

C. POLICY - INVALID NONWORK REASONS

3. State Driver's License or Identity Card

A driver's license is not a “valid nonwork reason” for assigning an SSN and SSA will not assign an SSN for this purpose.

well thats true you need to apply for EAD first to get a SSN...but if you just want to apply for drivers license with K3 visa you can ask for the rejection letter from Social security office tell them that you want to apply for DL..the DMV will accept that without SSN...

well thats true you need to apply for EAD first to get a SSN...but if you just want to apply for drivers license with K3 visa you can ask for the rejection letter from Social security office tell them that you want to apply for DL..the DMV will accept that without SSN...

Provide written notice using Form SSA-L676 to explain that an SSN cannot be assigned or a card issued because he/she did not present appropriate authorization permitting him/her to work in the U.S.

I applied for SSN without EAD yet. I presented my passport, I94 and birth certificate. It is best to apply for SSN after 14days of arrival in the US. Your data needs to be encoded in the immigration system and it takes at least 2 weeks.

After I got married I had my SSN changed into my married name. I applied for a driver's license after I received my second SSN card (married name). I passed my behind the wheel exam last Nov 3.

You can actually apply for SSN without EAD.

K1 visa

The OP is here on a K-3 visa, and they must have an EAD prior to getting a SSN. The only reason K-1s are allowed to be issued SSNs, as I understand it, is because some states laws would not let them get married without one. I know the DMV here will accept a rejection letter from the SS office. DMVs certainly vary in their requirements, though. We have a dilemna, as my DIL has a SSN because she was here on a J-1 visa previously. It is in her maiden name, and the card, which she threw away, cannot be replaced until she gets an EAD. So we're trying to figure out if the DMV will accept the number in her maiden name without presenting a card. It's her number for life, but is someone going to think she is trying to steal someone's identity? I sure hope not.

The law seems somewhat unfair to spouses who come here on a K-3 visa.

What I would have her do is correct the name on her SSN record and then request an SSN Verification Printout. That will give her some proof of her SSN and the name on record until she can be issued a card and then she only needs to apply for a replacement card, since the SSN record will have already been corrected.

RM 00203.510 D4 Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be corrected if the alien has provided documentation supporting the change, e.g., a name change.

If the alien provides documentation supporting the change, process the SS-5 to update the Numident information but suppress the issuance of a card.

I don't know how it works in other state but I just want to let you know that I got my ss card w/out my EAD. It doesn't hurt to inquire.

If you did, your status was not K-3.

SSA is a Federal goverment agency, all office are supposed to be operating under the same procedures.

K-3 + No EAD = No SSN Simple math. LOL

Thanks for that very helpful information. I am even going to print it out to put with her "arrival" paperwork. Now to get her here. It's not exactly easy getting out of Bangkok these days.

I would like to seek advice from you guys :)

We went to SSoffice and unfortunately they didn't issue me a SSN. I brought with me my marriage contract, birthcertificate and passport with visa with my MAIDEN NAME on it . I'm K3 by the way (but my name on my passport and visa is my MAIDEN NAME) .The lady there told me that I need to wait for my permanent resident visa to be approved with my new name or MARRIED NAME before they can issue me a SSN. :wacko: Once the permanent resident visa is ok, they can issue SSN with my MARRIED NAME on it. :clock:

Also, Do I need an SSN before I can get a driver's license?

Lastly, can I work immediately once I have an EAD?
