With regards to domicile, is getting health insurance an easy option? Since we wouldn't have our own house we can't get home insurance. And, my husband would be keeping our car in Canada until he received his visa and would bring it with him upon entry.

Since you're not working in the United States you can apply for Medicare. Remember they want to know that you are living in the US at the time of interview, so I would suggest to go to the US before the interview just for the show.

That might be complicated with CRA for your parents. We didn't have any insurance, but the company that we had registered saved us. I just mentioned things that they asked from us. I am pretty sure just Medicare is sufficient.

Yes, I do plan to move to the US before my husband's interview. If it takes a couple of months to process, so be it. It will be hard, but we'll have to do it.

Was applying for Medicare pretty straightforward? Can it be done over the phone or did you need to go into an office to do everything?

 

And sorry, what do you mean "the company that we had registered saved us"?

She went to a place called "River Fund" in Queens NY. You should be able to get help in Churches and other religious centers. And it's a very easy process anyway. Don't forget to get your Driving Licence.

We registered a company in NYS to start our own business when we get there. It costs just a little bit but helps them trust you easier.

For the business, did you end up actually starting one? I do plan to actually start my own business in the near future, so it might make sense for me to register as well. Was simply having that business registered something that you think greatly helped prove your domicile then?

No I didn't. We ended up going to NJ instead. We will have to register another one later after we settle down. And the answer to your question is "YES". My wife didn't sign up for Medicare period to our interview and that saved us.

Just a quick question, my Husband who is a US Citizen and the petitioner just bought a house in the US.  Will the buy/sell agreement be enough to prove Proof of Domicile? 

 

Also, his driver's license will have his parents address on it until he takes possession of the house - is it still usable to show he lives in the USA?

Our house purchase was in escrow at time of interview and the interviewer dismissed it. (Although to me that shows very good intent of reestablishing domicile but I'm not the one making the decisions.)

 

If the house sale has finalized by the time of your interview and you can show proof then there shouldn't be a problem. If it is still in escrow then it depends on the person conducting the interview. 

 

Sorry but I have no idea if they will just take a driver's license.

Hi Everyone,

I applied for IR1 my Spouse is a US citizen but currently in canada living with me. I had an interview on june13. rejected due to domicile, i am on admin processing now. CO specifically said, there are many things we can provide to satisfy the domicile requirement, but for me, he just needed the job offer letter for my wife. Although i had my wife's medicare,DL, my daughter's cal state medi card, BoA statement. CO said those info's are okay but not concrete. He said to submit the job offer letter. He kept my passport and said it will take about 2-3 weeks for the passport with visa. The document for job offer letter was submitted on the date of the interview(june13) via email. and i got a acknowledgement of the email right away in 5 mins. Any suggestions guys? im getting reallllllllly worried based on reading the stories. 

 

PS. They are very strict on proving the domicile.

Similar to May2016, went for interview on June 16th and I was rejected due to domicile. Our lawyer said it seems like they've become more strict lately. They asked for a job offer for my wife or a lease but I feel like what they want is a job offer. We were planning to start a business once we move there so we're not sure what to do yet. Has anyone been asked to prove residence and was successful without a job offer ?

Montreal has always been strict - this thread goes back to 2008.

 

One person was approved at their interview by showing they were staying in a long-term residence hotel; I was very surprised. Another person, it seemed like nothing they provided was acceptable. I suggest you look back through this thread to see what people have had accepted.

When I went on May 24th, I showed them a copy of my House Insurance which had both my husband's and my name on it.  They accepted that.  I had copies of the house paperwork just incase it was needed.  My husband (the US citizen) is currently not working as he's on long term disability and they didn't have a problem with that.

Your spouse can still get a job offer; it is not like they have to work there forever, or at all, it seems.

Yes, since everything was ready over the phone regarding my wife's job. The manager wrote the job offer letter right away and I sent it by email to Montreal on the day of the interview. I just hope that it's in the acceptable format since it's on the company's letterheard.

Finally, Ceac status changed to issued today with visa in final processing message. It took about 2 weeks for them to review the additional document. Waiting for the waybill number now. Montreal seems to be doing well on their review cases.
