Proving domicile when not living in the U.S.

We sent a photocopy of our car title that we bought when we went to the US in September. Also a SSN letter when my wife changed her name in January and a bank statement from her US account. Still they sent us a RFE to be prepared for the interview. They completed our case but we need to provide proof of US Domicile at the interview. If we add her Driver's License to these documentation will that work?

I can't think of more documentation that we can add to what we already provided.

I'm assuming that your wife lives in Brazil with you. What they are looking for is proof that domicile is being reestablished. Somewhere to live or a job are the favourites. What have you done about these?

question. so the only thing that i DONT have in the us is a lease. i gave up my apt to pay for one for my husbands so that he had ties to canada.

i have bank statements. credit card statements. an active license. all originating from my parents address.

ive also been at my current employer for 2 years.

if i create a lease from my parents stating we live on the premesis rent free for a maximum for 2 months at which time rent becomes XX dollars does anyone see anything specific that id be missing that proves my domicile?

This is really spooky stuff.

We are both in Canada now. My wife (the USC) works part time here - she can get a job easily as she is a nurse but our intent is that she remains 'retired'.

We will have:

  1. a joint sponsor (stepson)
  2. assets sufficient to meet the threshold on our own
  3. additional assets - a house in Canada that we will not likely sell until we get through - it will certainly be listed by the interview - we may sell as we get closer but why go through the hassle of finding a temporary place to live here - I won't quit my job here until I get the okay at the interview
  4. we will open a bank account there soon
    we will tranfer a decent sum of cash down there before the interview
  5. a rental agreement with my stepson that we will pick up his utilities and pay xx dollars on top toward their mortgage
  6. we will start paying my stepson's utilities as part of our rental agreement a couple of months before the interview
  7. wife will get her driver's license switched to down there a few months before interview
  8. possibly have one of our vehicles down there and registered by then - it will be a 2,000 mile trek
  9. neither

of us will have a job unless we are very fortunate as things get closer

Any other suggestions?

The more I re-read this thread, the feeling of dread gets worse.

My husband (USC) and I both live in Canada, he attained Canadian PR through me, has been here for a year and now wants to move back home to Florida.

He still maintains a US bank account in which he pays off the lien on his car from the US bank, he also transfers money from his Canadian bank account to said US bank account.

He still maintains a US credit card but hasn't had much active use lately since he's here in Canada.

Now that hubby is living/working in Canada, we need to get his father as a co-sponsor (another headache in itself)

Here's what we have:

1) A letter from my US father in law stating we will be staying with them until we find an apartment to move into when we move back to Florida.

2) A rental agreement with my FIL

3) Bank statements from hubby's US bank account.

4) Credit Card statements

5) I will be obtaining a letter from my employer that I am leaving my place of employment due to relocation to the US.

6) A Joint US funds bank account with RBC.

7) I plan on obtaining a quote from Uhaul for our move from Toronto to Florida.

8) We are planning on opening a joint US bank account as well.

Registering to vote was another piece of evidence people have brought to the interview in the past. Through research, we need a DL as one of the proofs to register to vote, he can't do that since he doesn't have a valid FL DL now.

I'm torn between having hubby move back to FL soon to prove domicile or have him stay in Canada and have to prove he will be re-establishing domicile.

Any thoughts? Is my evidence enough or should I get more? I've already dealt with the frustration of immigration paperwork once for hubby's PR, now I have to do it all over again this time for me. Not happy.

What they are mostly looking for regarding domicile is that the USC either has a job or somewhere to live in the US. They do not have to actually move to the US although they have to move at the same time or before the immigrant. As I am not at home I cannot check when we sent the docs to prove reestablishment of domicile as we sent them either with the 130 or 864. The lease with your FIL should be OK as Montreal likes formal looking leases - make sure you have a copy of the lease when you go for the interview.

The driving license is a separate issue, it is not necessary for the USC to have a US DL to prove domicile but if you want to know the requirements for Florida then you'd be better searcung to see if the question has been asked before or posting a new question. Driver license requirements differ by state.

I have ask my FIL to look into the DL issue at their local DMV.

It can help but you'll need a lease, rental agreement or mortgage to show you have a "home" to move to. Bills and accounts should be addressed to your husband to that address.

I don't think #5 is necessary. They are only concerned about the USC. Make sure your husband's address with his US bank account and credit card is your FIL's residence. Otherwise that information is fine. You've shown that your husband has provided you with a place to stay and is establishing a life in the US. He may think about moving early to job hunt too.

BTW we also met playing COD!! LOL! It was MW2 and on the PC though not the PS3. :)

Hubs works for EB Games (US Counterpart of GameStop) we were thinking to look for a transfer if anything shows up, somehow I doubt we will be that lucky!

Haven't had an interview yet... still at the initial stage like you are. LOL We do still game together but MW2 is a little dead so currently when we shoot together it's BF3. I still hop on mw3 and bops2 though as I have friends that play. He finds the game play frustrating. We really enjoyed portal 2 as a couple though. I wish they had a similar co-op we could find. Sometimes he shoots with me and other times he plays an MMO with his brother who is stationed in California with the Navy. We'll always game together though. :D

it sounds like you have a canadian us funds account? that doesnt count.

open a us account through rbc.

you can do it in canada under a us address.

and you can freely transfer funds between the 2

Yes, we have a Canadian US funds account with RBC. We are looking to open up an account stateside with TD Bank as there supposedly is a branch close to my in-law's. There used to be a US branch of RBC stateside but apparently that's no more.

I hear of couples meeting thru WoW alot!!! No need to be embarrassed! With this day and age, internet makes everything and anything possible!

Are you able to go to a physical RBC branch in the US? All I can find the RBC US website are ATMs... The account manager at my home branch in Toronto told me that they did have US branches but that's been changed.
