EAD question - really need to apply for it?

hi,

i'm in the process of putting together AOS package for my fiancee these days.

and i was just wondering she really needs to file for EAD even if she has no plan of getting a job for about another 6 months or so. by that time, she will already have received her temporary green card(when everything goes as planned). is EAD mandatory for every k-1 holders? or can k-1 holder wait until getting a green card to apply for a job. i understand there would be no problem getting a job as long as a person has ssn and green card. any advice?

Most states will give a drivers license with the EAD.

15 Sept 08 Application returned erroneously K2 not within 90 day timeframe

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

You don't need to apply for EAD... but most people get one even of they are not planning on working.... It can be used as an ID card and will make it easier to open bank accounts and get a drivers licence..

But its up to you if you dont want to lay out the money then don't file for it...

I wouldn't count on having your green card in six months - you might have it by then, but you might not, and there's a good chance you won't. If she wants to work within the next year or so, I would apply for EAD - at least three months before she wants to start working.

I just sent in the AOS package for my wife and I did not submit for the EAD or AP. In Florida you do not need a EAD to get a Florida Drivers License.

Hey Peter, Good to see you back.

Have you actually gotten that DL? We are in Florida also and just completed 10 months of fighting to get a license. Getting one on the I 94 is no help it expires in 3 months. The DMV will take the 797 for adjustment but your married name wont match SS #. The SS folks don't like to change the name until they see an EAD or a green card. I can't tell you how many hours we have spent at DMV and SS offices.

We finally got a license based on the EAD that will expire when the EAD expires.

I just sent in the AOS package for my wife and I did not submit for the EAD or AP. In Florida you do not need a EAD to get a Florida Drivers License.
