I'm a citizen and plan to file petition for my brother to come here in the future. What do I have to do to make sure that his wife could come with him ? Thanks a lot.

She would be a derivative beneficiary. The forms will lead you in the right direction.

It will take you many many years to bring you brother and his wife. they are issuing visa to applicants who applied on or before 15 April 1986. So you are looking at a wait of about 22 years from Thailand.

I believe you are mistaken. It's a 22 years wait for sibling sponsored immigration from the Philippines. From Thailand, it should be about 11-12 years; currently processing Jan 1998.

oops yes you are right it is Jan 1998 so 10 - 12 years, assuming the immigration reforms don't eliminate this category as they where planning to do.

There has been some talk of eliminating the category by some folks, but I don't think it will be under the Obama administration and Democratic Congress. Comprehensive immigration reform is a 2nd tier priority after the economy, expiration of the Bush tax cuts, national security, and the wars in Afghanistan and Pakistan which are higher on the list of things that need to be address. Unless there are serious talk of immigration reform, all the talk about eliminating the category is just talk.

By eliminating the category, do you mean US citizens petitioning their siblings and not allow them to immigrate as family members at all? Or adding them to a different category?

Thanks in advance,

Diana

The Bush White House proposed eliminating the sibling and adult children preference categories for family-based immigration. It's merely one of many proposals out there concerning immigration reform. I am not worried about this particular proposal with Obama and a Democratic Congress.

Here is a article outlining major immigration proposals from May 2007. www.fairus.org/site/DocServer/FTTFLegislationSummary.pdf?docID=1441

A proposal is not a law. It is merely people offering suggestions to reform laws. Some are garbage that will never get far, while a few will be seriously considered. Don't worry unless there is serious talk from Congress about immigration reform. There has been no major moves in immigration since Reagan was in office.

That makes no sense at all. You would think they would change the category to process the visas faster in order to diminish illegal immigration. Getting rid off the category altogether will have a completely different outcome. In my opinion, more illegal immigration.

Thanks.
