Hello all,

My understanding is that when a tourist comes to the US, they have to declare all of their possessions which they intend to leave in the US and then pay a tax on anything over $100. Does this mean that people coming on a K1 who have the intention of staying indefinitely after the marriage have to declare and pay a tax on every possession they have with them, including things like personal laptop computers, clothes for the wedding, etc.? If so, could someone tell me what the rate of the customs tax is? Also, does anyone know whether my fiance will be required to have the money on him at the airport, or if we will be able to send in a check later?

Thanks for your help!

Jillian

No, K1s are treated like intending immigrants, not visitors, for customs purposes

Thanks! Does that mean that he doesn't need to fill out the declarations form they hand out on the plane or just that they won't charge him for it?

He does have to fill out something. I forget the specific form number, but he'll fill out what immigrants fill out.

I'd read up on cbp.gov regarding rules and regs governing intending immigrants. My wife came (from India) back in 05 and she did have to fill out a form but she didn't have to pay anything. And she brought a lot with her. I believe intending immigrants get more than one trip to bring all their possessions as well. Read the rules on cbp.gov for specific details.

Man is made by his belief. As he believes, so he is.

You will need to fill out the customs form that is given out in the plane and you can declare if you are carrying cash, jewellery (significant enough) and if its personal or for commercial use. There is no penalty or check for valuables worth $10,000 per person. Its always good to declare.

There is no special paperwork for intended immigrants... Everyone including non-immigrants, intended immigrants and USC's fill out the same customs declaration

Intended immigrants (CR/IR visas) DO NOT fill out the I-94 however K-1 visa holders do

YMMV
