Hey everyone,

I met my girlfriend online, lol like most others on here i guess... and yeah, we've been talking about how i'm gonna get there to stay. Same again, naïve as hell, thinking i can just go there, get married and stay... NOT!!! :blush:

Since she has two girls, i'm wanting to move to the US to live with her, but i can't figure out what the best and fastest option is.

I'm from belgium, she's from TN, we met online in september 08, visited her in october, november and will see her this christmas, wahoo!!!!! omg, i cant wait!!!!!!!!!!!!!! :dance:

Any suggestions would be very welcome!

My opinion would be to go down the K1 route fiance visa, and file as soon as possible, you are looking at around a 7 month time frame if there are no problems and everything goes through smoothly

Hey thx, i assumed K1 would be the best way, i did look at the guides and it looked the best option, so she has to file that right? one more problem, she was married but has been seperated for a while now, not devorced yet, what about that, does she have to wait a while before she can file the K1? :wacko:

Yep sorry to say when you file for the K1 you have to be free to marry, so you will have to wait till the divorce is final, and yes she will file the petition

thats a bummer, hope the divorce comes through soon

yes you can stay for 90 days, but do not abuse this

You have to be in your own country for longer than in the USA, you can not just stay 90 days return home and go back all the time as you will get denied entry at POE at some stage if you keep doing this, this is just for visits and not prolonged stays. You can always try and apply for a 6 month visa.

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

It's a visitor program, so you need to be outside the US for more time per year than you are inside. Other than that yes, generally they give you 90 days each time. However, it is totally up to the immigration officer at the airport; they can give you less, or even refuse you entry if they suspect you'll stay (so it is generally better to say you are going for a holiday/ to visit friends than to say you are visiting your fiancee- always be truthful, but don't volunteer too much info!). For example, I was almost refused entry once because I was flying to the US for the sixth time in the same year, even though each time was for 2 weeks or less; in the end they let me in, but gave me a stamp for only 10 days (one day past the date on my return ticket).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

My fiancee also has 2 kids a boy and a girl. Started K1 already and included kids in petition already. Go the K1 route.

Has to have copy of divorce decree and then it can be filed can't have a husband on paper and a finance no matter how long separated

If you two are planning on getting married - then she's going to have to go though the official divorce anyway whether it's K1 or K3 - so she may as well start the proceedings asap. Other than that - you could see if getting in through a work visa was possible - if your goal is just to be near her.

Unfortunately there aren't really any shortcuts - so talk with her and make your plans accordingly. Read up and follow the rules... it may take a little while, but it's worth it in the long run.

Be aware also that not only does she need to be divorced, but some states also require a set amount of time after the divorce is final before the person is allowed to marry again. If her state is one of those, she technically cannot file the paperwork before that period is up, as she must be free to marry when it's filed. Don't forget to check for this before you spend the money on this process!
