Social Security Number after wedding in the US?

Hi VJ members!

my fiance and i are planning to just go ahead an get married in TN, we are thinking of just applying for my Social Security Number later after our wedding when we get back to NC.

we found out that in TN we can get our marriage license even i do not have SSN yet all i have to do is show my passport with valid visa.

Will this be ok?

Go to a Social Security office.

Take your passport with you 1-94 and get a SS number.

Took us about 10 minutes, and it's free of charge

That would be fine. We married without a SS, but we moved quickly: married, AOS, & applied SSN all within the first week of being in the US. I mention this because its okay apply for your SSN after you marry, but after so many days you will not be allowed to apply for it because your I-94 will be expiring.

Whether you apply before or after you get married is up to you and shouldn't matter. However, some SSA offices seem to get confused when a K-1 has married and applies in the married name. If it was me I would apply now and worry about the name change after you are married. Just be sure that once you have your SSN and are married you go back to the SSA office to apply for the name change right away. Once you have been here 76 days you must have an EAD card or I-551 stamp or card to be assigned an SSN and/or issued a card.

If they give you a hard time applying in your married name, first ask for a manager and tell them to read RM 00203.500 C1 and RM 00203.210 C.

You can apply for SSN 14 after your arrival in the US and 14 days before I-94 expires (before the 76th day).

You can apply as soon as you arrive, just that it might help by waiting 10 days to allow immigration to record your entry in the system SSA uses to verify your immigration status, but nothing requires you to wait. In fact if the SSA office follows procedure, they are supposed to hold the application until you have been here 10 days if you apply before being here 10 days and then try to again verify your status before sending the secondary electronic verification request.

The 14 days before your status expires is the limit on when the SSA office can clear the application once your status has been verified. You could possibly apply the first day you arrive and enter the 14 day period waiting for your status to be verified and not be eligible. Best to apply ASAP, to give yourself some breathing room for the verification to be done. I say at least a month before the 76th day. Nothing to stop you from trying on the 75th day, but you better hope they can verify your status on the spot and clear the application that day.

We tried to apply for SSN first week of December but the lady at SSA said that I need to change my status before I can get my SSN in my married name. she can approved my SSN in my single name but we want it to be in my married name is it possible to apply for my SSN using my married name without applying for AOS yet ? so i can go to SSA tomorrow to apply for SSN. I need SSN too for my husband Income tax refund.

what do you mean by SOL? I went to SSA yesterday the lady assisted me on the window said i need to change my status to INS and they can't issue SSN to me even in single name. how can my husband file his income tax without my SSN? can we apply for W-7 individual taxpayer identification number (ITIN) but i need letter from SSA the they denied my application.

SOL is a technical term that your luck has ran out. LOL

I assume the SSA office is now saying you need to change your status before an SSN can be assigned because you have been her 77 days.

SSA will not assign an SSN or issue a card if your status is expired or within 14 days of expiring. K-1 status is good for 90 days, so that gives you 76 days to apply based on the K-1 status. You have been here 77 days, so you are SOL to be assigned an SSN based on K-1 status.
