After a very long wait time, we have finally received the letter with the date for my husband's AOS interview. Problem is, he will be out of the country. He has already booked a ticket to travel back to Peru from January 8-February 19 to visit his son, and the interview is scheduled for January 16. I tried calling the Customer Service number on the letter, but I spent 20 maddening minutes getting sent from one recorded message to another. No matter what I did, I couldn't get a human being on the phone, even though the recording says the line is staffed with representatives Monday-Friday (yes, I tried pressing zero). We have a local office here in Denver, but I can't locate a phone number. Anyone have any ideas?

When did you try calling? Maybe they are on Thanksgiving holidays?

If you do you will receive a letter of denial for your AOS and be given 30 days to leave the USA. Your husband would be better to change his flight dates.

Change your trip for some other date and attend your interview

I also forgot to tell you one very important bit of info. If your AOS is denied and you are outside the US at the time of denial your AP will be void and you will not be allowed to re-enter the US. You will be denied entry and returned to your home country at your expense and will have to start from scratch with a spousal visa.

Your husband must change his travel plans. My husband was halfway around the world during my appointment date but he flew back for 36 hours in total to attend an interview that lasted 20 minutes. The interview time was 9.30 AM but we didn't get seen till 9.55 and were out of there at around 10.25 AM. His flight out was 1 PM.

Federal offices were generally closed today for a long Thanksgiving weekend. Try again Monday. Everyone advises that your husband make different flight arrangements -- depending on how the flights were booked, there is a fee to change the dates etc. If that's really impossible, you may or may not be up the creek and you will end up regretting the outcome.

USCIS will consider your I-485 petition "abandoned" when you don't attend the appointment. USCIS will send a notice of denial of I-485 to your address.

Unfortunately, I-485 denials can't be appealed. if a denial, a qualified immigration atty must be hired to file a MTR (motion to re-open) the 485.

1/12/09...........USCIS mailed Notice of Intent to Deny. Evidence: Conflicting statements made by USC spouse at the interview to proof to officer that the marriage was bona fide.

March 2009......Received Denial Notice of I-130 and 485.

Personally, I would just change my plans to visit my country. This is just too important and anything gets messed up the result can be more than you bargained for. All the best

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks
