Timeline

At the time we did our K-1 visa we used a lawyer.All good and happy untill I started to put together the documents required for AOS.That is when I realised that my husband(USC)had a courtesy copy of the Notice of Approval that stated that the original was sent to our lawyer.

As the courtesy copy of NOA that we have states that we can not use it as a proof of approval I contacted our ex lawyer to send us the original.But what do you know?He was only able to send us a copy after the original NOA which i used with my AOS application, but he stated that he sent the original to us back in August 2005.We never got it in the mail.

My concern now is how could I get another original NOA as I know that it will be required for my AOS interview.

Any ideas?

I believe the approval NOA is required with the AOS.

You can submit an I-824 to receive a new copy. The fee is $200.

You can find it here...

Isn't this process absurd? The issuing agency wants you to bring the very document that they themselves issued, and if you've misplaced it they charge you $200 to re-issue it.

Wow! $200.00. Looks like an item that should go on household insurance! I shall definately make sure I know where ours is...

I find it hard to believe that the attorney didn't make a copy of that approval notice for their files. If he doesn't have it, then he is incompetent.

Even if they did send it to you, I would send in your copy of the approval notice with your I-485 petition and see what happens

I had to apply for my NOA after I never received one, and got an RFE for not having it with my AOS application. I hope everything works out for you!

AOS Timeline

May 2/05 Mailed AOS Package

June 7/05 Received NOA1 for AOS

July 1/05 RFE received for no I-129F NOA2

July 6/05 Fingerprinting & Biometrics

July 7/05 Mailed I-824 to CSC

July 26/05 I-824 returned to us/error on application

July 28/05 I-824 mailed to CSC

Aug 11/05 NOA1 for I-824

Oct 11/05 Received I-797C for I-129F (FINALLY!)

Oct 13/05 Mailed I-797C (RFE) back to Lee's Summit

Dec 12/05 Received Interview Letter for March 29, 2006

Mar 14/06 Received letter about interview cancellation

Mar 22/06 Received Interview Letter for May 25, 2006

May 25/06 Interview in Louisville

May 25/06 Received 3 emails that welcome letter is on its way

May 27/06 Case touched

May 30/06 Received welcome letter & letter about GC (GC should arrive within next 3 weeks)

Try zyggy's suggestion, including a letter of explanation and the photocopy that the attorney sent you with the 'courtesy copy'. It may save you $200.

Thx you guys.I did included the copy with my AOS.I am now worried that they will ask for the original at the interview and i don't have it.

And yes it is absurd to pay $200.
