SSN Card Valid Only With DHS Authorization

I thought I'd share my recent experience at the local social security office, with regard to obtaining a social security card for my (K-2) daughter.

I knew from my earlier contact with the SS office that I could not file for a SSN for my daughter until after she received her green card, so a short time after it arrived Natasha and I gathered up our documents and headed down to the local SS office.

After reviewing our form, the (very nice and helpful) woman typed up all the data into her computer, which promptly rejected the application. It didn't like the part where we had listed her 'name at birth'. Apparently, this name wasn't in their computer anywhere and she had to add it before she could process our daughter's application. Seems silly to me that no form at any time up to this point for the SS office (i.e., Natasha's SSN application) had listed her maiden name, but whatever. Natasha handed over her SSN card (her second, after changing her last name) and the woman said it wasn't valid - because it had the all-too-familiar 'valid for work only with DHS authorization' phrase printed on it. The woman patiently explained that now that Natasha had her permanent resident card, she needed a new SSN card that didn't list this restriction, since the green card removed all such restrictions. She actually confiscated the card and said we'd receive a new one (minus the restriction) in the ubiquitous 7 to 10 days.

Just thought I'd put this information out there in case it helps anyone.

Its ironic that SS says that a minor can only get a SS card with a green card in hand or with EAD. I couldn't quite figure it out cause my daughtyer is only 8 years old and I don't think she'll be working anytime soon...Other oddity is that it would take atleast 3 months to get her EAD and by then her I94 will be expired so we wouldn;t be able to get it until the green card anyway...so i dont know why they just don't say u gotta wait for the green card. lol

AOS -K2 Based for 8 year old daughter...wife already has green card in hand and daughter was brought over via join to follow - K1.

11/04/08 - I485 sent

11/10/08 - NOA rcd

11/26/08 - Biometrics

you are nut understanding... You can get EAD for a child after the I-94 expires....

SSN is also needed for the child for IRS purposes... For those who are SSN eligible cannot receive an ITIN
