NEED HELP ASAP I130 APPROVED LAWYER DUMPED ME.........

Timeline

Hello everyone and congrats to everyone whose VISA was approved..........This is a long drawn out process and I just can't take it anymore. How can ppl decide when you to be with the one you love.... Anyway here is my dilema, oh I have to update my timeline..........

I130 filed oct 2007

I129F filed June 27

i129f approved on Oct 21, 2008

i 130 Approved on Oct 28, 2008

NVC received info and sent out pkt 3 to lawyer on Nov 4, 2008

Now, I had a lawyer who have I guess basically filled out the paperwork for me and sent to USCIS.....

Now that everything is approved from USCIS and I was inquiring with him about the next step because I absolutely is lost to this immigration process and wanted to know how the process goes and the next step (after all I thought this is why I am paying him to help me through this process) He tells me yesterday (in short) that he never seen a person that emails so much back and forth and ask so many questions and he feels as though I need to find another lawyer... How about that..It really hurt my feelings because that's what I thought that's their job. We are almost done and now this. I don't know what to do. We got a lawyer in the first place because my husband got detained in Dec 2006 for attempt to enter US on fraudlet docs. he incarcirated for a few months and deported back to Jamaica.

I am stuck .....The lawyer has the pkt the NVC sent rqst the AOS and etc. I know we need waivers and so on I don't know which ones we need, perhaps the i601 and ? . But do I need to recruit another lawyer or do you do think I can do it on my own.... Or should I continue with the i129f then do adjustment of status.... I thought it would only take weeks after NVC received the info for an interview, however, the lawyer tells me months and that was the arguement..........I asked how is it months...............pls help... :wacko:

I'd get another lawyer as the question of his illegal immigration activities will likely come up at his embassy interview. Doesn't matter if it's a K3 or CR-1 interview.

Just my 2 cents.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The length of time between completion of the process at NVC and the scheduling of the interview is different and it depends on how quickly the particular consulate you're dealing with schedules these things. It can sometimes be a couple of weeks, and sometimes a couple(or more) months.

Given that your case is complicated by your husband's attempted 'fraudulent' entry, you definitely want to get another lawyer...you will need an attorney's assistance and advice.

Thanks for your reply. Just FYI my husband and I did get an attorney. Actually it's the same one. My husband spoke to him and he changed his mind.. However, I am not dealing with him directly because he and I clash, on the other hand, my husband seem to be a bit more humble than I so he will deal with the lawyer and I will deal with the assistant.. .. :blink::blink::bonk: The current lawyer has been involved with the case since Aug 2007, so I will pray he will put his best effort and complete the case.

Do you think it is wise to get him to come to the interview also. I hope not because then we will have to pay for his plane tkt, hotel, and transpo................ imagine that..............

You should have refrained from doing illegal things with Immigration thats why the lawyer seems to be pissed off. Anyway get a new lawyer and Happy Holidays!!

What illegal things? If you are talking about the fraudlet docs............ The lawyer knew about that from day one before he took the case and things were going well with us until now..........So that's not y he is pissed off.........

I'm sorry about your situation, the only thing I can think of is to find another lawyer. I wish you the best of luck though.

Maybe you could request that the lawyer provide weekly status updates on the happenings of your case.

You could also consolidate all of your questions into a weekly message so that the lawyer does not feel overwhelmed.

The standard time for the NVC is months. It takes VJ members less time because they use shortcuts that other members have used. Most of the people using the shortcuts do not have an attorney. Instead we spend countless hours checking websites, NVC automated systems and contacting NVC operators to find out the status of each step in the process. I don't think lawyers will have the bandwidth to do this for each of their clients.

Hi! I'm guessing your lawyer is just overwhelmed because it seems like you're going to have a big huge process involving an I-601 waiver for the fraudulent entry and potentially an I-212 for deportation if that was part of the situation as well. These are huge undertakings.

I strongly suggest that you visit the immigrate2us.net forum whenever you have the urge to ask a question. Nearly every possible issue related to inadmissibility and waivers is represented on there, and there are people filing at most consulates in the world. Sometimes it helps to hear from others who have a similar experience, even more than from a lawyer who is racking his/her brain preparing a waiver and possibly a battle at the consulate.

I'm glad things are working out with your lawyer, but if not, I suggest consulting with Laurel Scott. An email consultation costs $135, is super informative, and she's one of the most successful expert lawyers on foreign-filed waivers with all of the American Immigration Lawyers Association. I know I sound over-excited about her, but I know dozens of people who have a happily reunited family in the US despite crazy inadmissibility, thanks to her. So even if you just want a second opinion or something, I'd recommend her.

That's probably because you have a complex issue. People look at the arrest for breaking immigration laws and probably don't know how to help you. It's certainly not a common problem, so you might try a bit of patience. Do you really want 52 replies stating, "Sorry, I don't know how to help you."?

Hi sweetness, sorry for all the problems. Unfortunately, I know too many people who have done what your husband did and did not have a positive outcome (sorry). I have cousins who have done the same and have tried in vain to explain at the interview that they didn't know the docs they were entering the US on were fradualent (and that's where the interview ended). They now have a lifetime band on entering the US. Would they have made out better with a lawyer, I don't know (really don't think so). They also spent time in jail. I wishing you the best of luck through this process.

One more thing, friends that have used lawyers to get through this process cost them an arm and a leg and they went through the same fustrations you did. I do have friends who have made it through, but the circumstances were slightly different. The SO never left the US. He was in jail for a while and the lawyer fought to keep him in the states. The case went on for years, but he was able to stay. This was years ago and the laws have changed.
