Hi everyone.if ever i will move on someday....Can a divorce filipina,can get a visa? what is the best option should i do? my husband wants me to file an anullment here in philippines. if you were me,what do you do? mariage dont work out:( An a friend told me,that anullment takes forever....pls advice,anullment or divorce? divorce is faster but no divorce here in my country....im so depressed:(

Just to clarify, did you go back to the Philippines? If so, do you have a green card? If no green card, when does the K3 visa expire?

We need the answers to these questions to determine your options.

Yes,I am Back home here now in my country.I dont have a greencard.....My k3 visa expried january 2008.

If a divorce was all that was required, then I am not sure why all (or mostly all) previously marrieds from the PI go down the anullment path. There has got to be a valid reason and that reason must be in order to get a CENOMAR for a visa, there cannot be a previously recorded marriage of any kind.

You have to be careful of the path you choose. If you file for divorce in the US, you do not regain the capacity to marry according to the law in the Philippines. If your spouse is not a citizen of the Philippines and your spouse files for the divorce outside of the Philippines, you can regain the capacity to marry according to Philippine law. It makes a huge difference to you who files the divorce petition. A divorce initiated by you (you petition for divorce) does not qualify you to get a marriage based visa in the future because the Philippines will not recognize the divorce and you will still be married according to Philippine law.

If your spouse is not Filipino you have 2 choices:

1. annullment

2. your nonfilipino spouse files for the divorce.

If your spouse is Filipino you have 1 choice:

1. annullment

How can I let them erase my mariage,If ever my husband, file the divorce in his country? my mariage is registered in NSO here.Is it true,that i still go for a court hearing here in my country...my husband says,even he divorce me,i still can't remarry and cant come back to the US if ever i want too.I am very confused and need more guidance....Im happy i found this site.

Get started on getting an annulment. Hopefully your hubby will pay for it. Average cost is about $2,000 US and takes about 6 months. You have to get the record of annulment with NSO to move on with your life.

Next time do a fiancee K1 visa.

Get started on getting an annulment. Hopefully your hubby will pay for it. Average cost is about $2,000 US and takes about 6 months. You have to get the record of annulment with NSO to move on with your life.

Or, as has already been mentioned above, have your USC Spouse file for and obtain a divorce in the US and send you a copy of the decree. If you want to be in control of this issue, you'll need an annulment.
