Hello everyone!

I had my visa interview on November 5, 2008 and shortly after that I have received my K1-visa.

However, I do not know anymore if I still want to get married.

What would I have to do with the visa?

Would I have to write a letter to the Consulate stating my reasons for not wanting to marry anymore?

What if I just visited the States in the next few months, would I have to enter with my visa or could I enter as a normal tourist? Would they let me enter as a tourist without my visa papers?

And what if the visa expired and I wanted to visit the States later on? Would I be refused entry or anything like that? Would they not asked me why I did not use the visa?

hhhmmm.... your visa was granted to you in the conditions and assurance that you love and will marry the petitioner.

but a fiance visa is not a tourist visa.

so if you give up being a fiance and decide not to marry, then the fiance visa can not be used in any way. if you use it, you will have to marry the petitioner if not, you risk being deported or even blacklisted by US immigration as they say.

however if you give up the fiance visa then apply for a tourist/visitor visa instead and enter as a tourist/visitor then you will not be obliged to follow the stipulations on the fiance visa.

its pretty simple... if you dont want to get hitched but just visit the US, tourist/visitors visa is the way to go.

but if you decide to get married and be with the one you love, then fiance visa it is.

its best to be always safe than sorry... just use the proper visa for its proper purpose.

but you can go to the US with the fiance visa. you have the 90 days condition to think if you really are ready to marry or not.

Don't be sorry for that Coria...you haven't done any such thing. They have applied for a different type of visa. Altogether.

This has already been covered. She may use the visa, have it cancelled or let it expire. There's no fraud if she uses the K1 and goes home before the I-94 expires (90 days). K1 visa holders must either marry the petitioner or go home within 90 days or they CAN BE deported. What you've neglected to mention is their perfectly legal option to simply go home instead of marrying the petitioner. There are no immigration related consequences for that.

If she wants to visit in the next six months and stay for more than 90 days, she'll need to have the K1 visa cancelled and obtain a B2 allowing a longer stay.

Okay, in case you want to cancel the visa you have to send the whole visa package and your passport back to the Consulate. They will then cancel it. I have received my passport today and my visa is NOW cancelled =) "Cancelled without prejudice". YAY!

Okay, in case you want to cancel the visa you have to send the whole visa package and your passport back to the Consulate. They will then cancel it. I have received my passport today and my visa is NOW cancelled =) "Cancelled without prejudice". YAY!

God bless you for all you've been through. I had read your story previously and was wondering how it ended; sorry it ended with all this chaos, but glad to hear you have taken charge of the situation.

Thats easy. go to US, dont get married DONT!!!! coz if you having doubts now, you really be in doubt and trouble after wards then there is problem..!!!! make sure you return within the 3 months so you dont overstay they visa. Just let it expire, they will be asking about next k-1 if you find americaqn to engage to. Tell them the last american fiancee was a big poopy head and im sure they will understand, as 50% or maybe more of us have been married to american poopy heads!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

hi coria how are u doing now? have you used your visa? whats your plan.thats also my probs with my fiancee, after i got my visa he suddenly dumped me. so worried now my visa will expire next month.

Hey, I am doing well. I am sorry it ended like that but I would advise you to get the visa cancelled as well. Like I said I have not used my visa. When I called the Consulate some woman told me that I was supposed to send the whole package and my passport back in order to cancel the visa. Well, it took about two weeks until the visa was cancelled. Hello Coria,

I am happy for you, that you already pass this trial in your life. We are almost the same, but mine is still on the earlier stage. It still with the USCIS until now, we had only the NOA1 and no NOA2 yet. But I decided to cancell it, since my ex-fiance is not treating me well, I sent a cancellation letter last december 2008, and until now, i dont have the feed back from the USCIS, hoping they will grant my letter, since no NOA2 yet. Take care.
