Ok, here's the deal:

My wife had her interview on Friday, May 15th at the US Embassy in London. It went extremely well except for some small minor details

Because my income won't suffice, I have had to ask my sister to co-sponsor my wife. My sister was great about it, filled out her I-864, attached 1040s and W2s, and I thought all was well, because her income is well above the required amount.

However, the embassy said that, because she filed a joint tax return, the embassy wants a I-864A from both her and her spouse, plus copies of either their birth certificates or passports to prove their citizenship.

I just don't get it.

If my sister is the only co-sponsor, and her W2s clearly show that her income and her income alone are sufficient for sponsorship, why do they need any information from her spouse? He's a US citizen, so we're cool, but still.

Plus, she originally thought that, because the tax return was done in both there names, they have to both agree to sponsor my wife. I said that wasn't correct, so we are both doing more research on that.

It's just MORE FRICKIN' hoops we got to jump through!!

I know that, in fact, it's not a big request, I just don't understand their logic sometimes.

I hate this process, I hate the whole thing! I just want my wife, of THIRTEEN YEARS, to be with me, is that SUCH A AWFUL THING that the government has to put so many obstacles in place to prevent it from happening???

I'm so sorry that happened -- that is seriously weird. My mom acted as my husband's joint sponsor, she files her taxes jointly with my dad and only she had to fill in an I-864. I am pretty sure that has been the norm in London over the past couple of years, so I am really surprised that this has happened to you. I can understand them asking for proof of citizenship if you hadn't supplied it for your sister, but asking for an I-864A sounds vaguely like someone talking out of their ####### at the Embassy that day.

You're right, you need to jump through the hoops on this one, but that is the first time I've heard of such a demand being made at London. Keep us updated about this -- if this is going to be the case going forward, it's good to know.

(I still think someone was talking out of their ####### at the Embassy though, even though I'm sure that's no consolation. ;) )

I'm more than happy to go back and ask my sister for a copy of her birth certificate or passport. In fact, that's probably something I should have included originally. My mistake.

The I-864 that my sister filled out included her 2008 1040, which she filed jointly with her husband. She also, however, included the past three years of her own W2's, proving her individual income.

As she was intended to be the sole sponsor (well, joint sponsor I guess, along with myself), I had her include her W2s as proof that her income, in and of itself, is sufficient to pass the requirement for support.

However, according to my wife, the embassy said that because the 1040 was filed jointly, both my sister AND her husband need to sponsor my wife.

That doesn't make any sense at all.

Why this is an issue is that, basically, my sisters husband got laid off five years ago, and have been going from job to job these past years. Lucky enough, my sister has been at her job for 20+ years, has a lot of seniority and makes enough to support them both.

This is why I didn't want to get him involved. In fact, I shouldn't have to get him involved! The one sponsor makes enough, regardless of how she filed.

It's a huge drag.

Wow! What a ride, eh?

Well, there were a couple of bumps in the road, the biggest was explained on THIS thread,

The bottom line is, my wife's Visa was granted on the 18th of June!

Oh, you didn't get that? Here, let me repeat that: WE GOT THE VISA!!!!

What a long, strange trip!

I just want to thank everyone here on these boards, the community of VisaJourney are the best people in the world, and we never, ever would have come this far without all your help!!!!

Met in the US: 2002

Married : 2007-08-03

I-130 Sent : 2007-08-13

I-130 NOA1 : 2007-09-26

Abandoned application and OH moved to the UK.

April 2009 starting all over again DCF this time.

Marriage : 2007-08-03

I-130 Sent : 2009-05-02

I-130 NOA1 : 2009-05-06 (no receipt received this is the date the money was taken from credit card)

RFE: 2009-06-02. Credit card receipts and dreaded RFE's.

RFE replied to: 2009-06-04. Hoping they have everything they need

NOA2 approved: 2009-06-11.

NOA2 received: 2009-06-15.

Packet 3 received: 2009-06-17.

Packet 3 returned: 2009-06-17.

Medical booked for July 13th.

Medical done, passed pending xray and blood tests.

July 13th: Still waiting for interview date...phoned DOS and they said everything is in order and we're eligible for an interview and to be patient...back to waiting.

Called DOS again 17th July, they said we have an interview date whoop!!

Interview: July 29th (hubby's birthday) WOOHOO!! Visa approved

SMS message 31st July saying visa will be delivered on Monday.

August 1st: Visa here!!!! whoop whoop!

So much left to do...but the worst is over :)

September 14th: POE Chicago
