Going home but no I-131/Advance Parole

Hi,

My financial situation suddenly changed and I can go home for Christmas (which I am very excited about as I have not spent Christmas with my family the last three years).

However, according to the rules I can't leave the country : ( I am at the stage where I have applied for Adjustment of Status/work permit and I just did the biometrics. However, I did not file a I-131.

So its three weeks till I would like to leave the country. And I would like to get the ticket as soon as possible. Is there any chance in this world that I can spend Christmas with my parents and my sister?

( I have read that one can get an emergency AP, but there is really no emergency.. )

You can leave the country anytime you want. It's coming back that is the problem. You better make sure what you are doing if you leave. Without advance parole, you probably can't return.

You can go to the local USCIS office and apply for emergency advance parole. No need to take the word "emergency" all that literally. Just tell them why you want to go. You'll have to pay a separate fee, of course but there's not likely a good reason to say no. Without advance parole though, your AOS filing will die, there will be no refund and you'll stay in Norway for at least six months while you go through a new spouse visa process. Don't leave without advance parole.

I don't have the patience and money to go through all this again. So I'm gonna make sure I have the right paper work. I like the idea about going to the local USCIS office and give it a try. Fingers crossed again : )

I am unaware of a separate fee if you have AOS in process...
